As I stated during our meeting on September 24, 1997,
CPL is willing to investigate the possibility of impact to soil and/or groundwater at the subject
site from operations of our historical pipelines. CPL is willing to conduct this investigation at no
cost to you even though no regulatory agency has requested that we perform this investigation.
As stated in our August 21, 1997 letter to you, should the results of our or any future
investigation confirm that operations of CPL's historical pipelines have impacted your property,
it is CPL's practice to provide a written commitment to comply with the requirements of
governmental agencies(pertaining to CPL's documented impact)with jurisdiction over the
property.
I understand that you have been negotiating the terms of the Site Access Agreement during the
last two weeks with Ms.Elizabeth Lu,representing CPL. CPL's final version of that agreement
is enclosed. CPL cannot proceed with the voluntary site investigation until this Site Access
Agreement has been executed.
