As I stated during our meeting on September 24, 1997, <br /> CPL is willing to investigate the possibility of impact to soil and/or groundwater at the subject <br /> site from operations of our historical pipelines. CPL is willing to conduct this investigation at no <br /> cost to you even though no regulatory agency has requested that we perform this investigation. <br /> As stated in our August 21, 1997 letter to you,should the results of our or any future <br /> investigation confirm that operations of CPL's historical pipelines have impacted your property, <br /> it is CPL's practice to provide a written commitment to comply with the requirements of <br /> governmental agencies(pertaining to CPL's documented impact)with jurisdiction over the <br /> property. <br /> I understand that you have been negotiating the terms of the Site Access Agreement during the <br /> last two weeks with Ms.Elizabeth Lu,representing CPL. CPL's final version of that agreement <br /> is enclosed. CPL cannot proceed with the voluntary site investigation until this Site Access <br /> Agreement has been executed. If you are in agreement with its contents,please provide your <br /> signature on Page 3 and return the document to my attention at the address on this letterhead <br /> Upon receipt,CPL will execute the agreement and will forward a copy to you for your records. <br /> In the event that you are not in agreement with the proposed Site Access Agreement,CPL will <br /> indefinitely postpone the proposed investigation activities at the subject site. <br /> If you have any questions,please call me at(510) 842-6877. <br /> Sincerely, <br /> K.
