As I advised you in our telephone <br /> conversation, there is a pending lawsuit in San Joaquin County <br /> Superior Court between our clients and Chevron USA and another <br /> former operator of the subject property as to the responsibility <br /> for the clean-up of any contamination to this property. You have <br /> advised me that the responsible party, Chevron USA, has failed to <br /> provide quarterly monitoring reports regarding the status of this <br /> property. <br /> In order to promptly and efficiently restore the monitoring of <br /> this property in accordance with the tri-regional requirements for <br /> evaluation and investigation of underground tank sites, I am <br /> requesting that we have a consultation with yourself and any other <br /> appropriate representative of the San Joaquin County Public Health <br /> Services to work out a proper investigation and monitoring plan <br /> that would satisfy the County's requirements and those of the <br /> Regional Water Control Board. I understand that your consultation <br /> fees are billed out at the rate of $53 . 00 per hour per each <br /> representative of the County. <br />
