Your letter <br /> obviously recognizes the four different definitions for"Responsible Party." We do not <br /> dispute being the current property owner, but we did object in our Appeal to the arbitrary <br /> order of the San Joaquin County Environmental Health Department to perform the <br /> requested work related to the"Notice of Responsibility." <br /> Well prior to Palisades' purchase of this site in November 1997, this site has been <br /> a recognized Exxon-Mobile release and they have been exclusively responsible for <br /> incurring all expenses with regard to the investigation and remediation of their prior <br /> release., <br /> Now,.without any meaningful data from Exxon's investigation, the County is <br /> wbilrgr ly directing USA.Petroleum to incur expenses to investigate the Exxon-Mobile <br /> release. As a result, our petition requested the State Water Resources Control Board to <br /> grant us relief from the County's arbitrary decision to require USA Petroleum to incur <br /> these expenses to review and investigate the Exxon-Mobile release. <br /> I believe it is consistent with the State Board's policy to require the culpable party <br /> (i.e., Exxon) to handle the investigation and cleaning up of a site. That policy is <br /> consistent with the principles of fairness and due process—that one should be responsible <br /> for their own conduct. We recognize why the"current property owner" is within the <br /> r <br /> definition of a"responsible party," eventually someone has to take responsibility if the <br />
