7 <br /> Palisades Gas & Wash -3- <br /> Section 2810(b) of the Fund Regulations requires a separate claim be filed for each <br /> occurrence. <br /> Section 2804 of the Fund Regulations defines "occurrence" as: <br /> "an accident, including continuous or repeated exposure.to conditions, that results in <br /> an unauthorized release of petroleum from an underground storage tank or <br /> residential tank. Unauthorized releases at the same site that require only a single <br /> site investigation shall be considered one occurrence. An unauthorized release <br /> subsequent to a previous unauthorized release at the same site shall only be <br /> considered a separate occurrence if the initial site investigation has been completed <br /> for the prior unauthorized release." <br /> Section 2804 of the Fund Regulations defines "initial site investigation" as: <br /> "a soil and groundwater investigation sufficient to identify where contamination <br /> resulting from an unauthorized release is most likely to be present." <br /> • Page two (2) of your claim application was incomplete. Clarify or revise "Site <br /> Address"(2705 County Club Blvd or 2705 Country Club Blvd). In addition, complete <br /> section on this page to show "Site Type"and list all USTs associated with this site <br /> (previous/current). <br /> • On page three (3) of your claim application, list all "Property Owners", "UST Owners" <br /> and "UST Operators" dating back to first release (9/27/91). <br /> • Complete page five (5) to include name(s) of"UST Owner"(s) and "UST Operator"(s) <br /> "at time of discovery of release" and "at time of application submittal'. <br /> • Claimant is requesting priority class "C" and must submit documentation verifying <br /> that claimant does not employ more than 500 full time or part time employees. <br /> Submit docurnentation supporting the number of employees 0.&. Department of <br /> Employment Development (DE6) for the last quarter-prior to date of claim application <br /> submittal) for claimant, including all affiliates, and USA Petroleum Co. <br /> Section 2811.1(b) of the Fund Regulations states: <br /> "For purposes of assignment to a priority class, the Board will base the priority of the <br /> claim on the lowest priority appropriate for any claimant, including any joint claimant, <br /> the owners and operators at the time of discovery of the unauthorized release, and <br /> the owners and operators at the time of application to the Fund, unless the claimant <br /> can demonstrate to the satisfaction of the Division that such treatment would be <br /> inconsistent with the priority scheme mandated by section 25299.52, subdivision (b) <br /> of the Health and Safety Code." <br /> California ErrWronmental Protection Agency <br /> s� <br /> P.a Recycled Paper <br />
