7 Palisades Gas & Wash -3- Section 2810(b) of the Fund Regulations requires a separate claim be filed for each occurrence. Section 2804 of the Fund Regulations defines "occurrence" as: "an accident, including continuous or repeated exposure.to conditions, that results in an unauthorized release of petroleum from an underground storage tank or residential tank. Unauthorized releases at the same site that require only a single site investigation shall be considered one occurrence. An unauthorized release subsequent to a previous unauthorized release at the same site shall only be considered a separate occurrence if the initial site investigation has been completed for the prior unauthorized release." In addition, complete section on this page to show "Site Type"and list all USTs associated with this site (previous/current). • On page three (3) of your claim application, list all "Property Owners", "UST Owners" and "UST Operators" dating back to first release (9/27/91). • Complete page five (5) to include name(s) of"UST Owner"(s) and "UST Operator"(s) "at time of discovery of release" and "at time of application submittal'. • Claimant is requesting priority class "C" and must submit documentation verifying that claimant does not employ more than 500 full time or part time employees. Submit docurnentation supporting the number of employees 0.&. Department of Employment Development (DE6) for the last quarter-prior to date of claim application submittal) for claimant, including all affiliates, and USA Petroleum Co. Section 2811.1(b) of the Fund Regulations states: "For purposes of assignment to a priority class, the Board will base the priority of the claim on the lowest priority appropriate for any claimant, including any joint claimant, the owners and operators at the time of discovery of the unauthorized release, and the owners and operators at the time of application to the Fund, unless the claimant can demonstrate to the satisfaction of the Division that such treatment would be inconsistent with the priority scheme mandated by section 25299.52, subdivision (b) of the Health and Safety Code."
