(LOF)has reviewed correspondence dated October 15,1997 from San <br /> Joaquin County Public Health Services(SJC)regarding the removal of a 5,000 gallon underground <br /> storage tank(UST)on August 29,1997. LOF takes exception to the conclusion that further investigation <br /> is necessary at the site. <br /> Upon removal of the UST and under the direction of a member of SJC, six soil samples were taken for <br /> laboratory analysis. The results(copy enclosed)were"not detected"with the exception of the sample <br /> taken west of the UST. The results from this particular sample were"not detected"except for MTBE <br /> which had a value of 0.0060 mg/kg. It should be noted that the laboratory's reporting limit was 0.0050 <br /> mg/kg. It is LOF's understanding that a regulatory action level for MTBE has not been established <br /> though some agencies have used 35 ppb as a guideline. SJC should also take into consideration where the <br /> site is located and historic events related to surrounding uses. <br /> Based upon the above cited information,LOF is requesting that SJC remove this site from the list of <br /> contaminated sites in the county. LOF believes that this site does not pose a risk and closure is <br /> appropriate.
