They were constantly searching to figure <br /> out what had been done on the site, what had already been <br /> paid for, and what their responsibilities were. As a <br /> result, Neumiller & Beardslee was continuously calling to <br /> encourage that reports be submitted in a timely fashion. <br /> After all of the work in the original contract was <br /> completed, Ruiz Grocery anticipated amending the scope of <br /> the work.:--to include the feasibility study, . installation of <br /> the groundwater extraction well, and completion of a <br /> Problem Assessment Report/Corrective Action Plan. Because <br /> Ruiz Grocery is limited in its ability to pay for <br /> remediation up front, the agreement for payment in the <br /> contract between RESNA and Ruiz Grocery included payment <br /> upon reimbursement from the State Underground Storage Tank <br /> Cleanup Fund. RESNA is no longer willing to work under <br /> these terms, and thus requested a termination of the <br /> contract. <br /> Ruiz Grocery had already obtained three bids for the <br /> investigation phase . RESNA's termination occurred at an <br /> inopportune time. Rebidding this portion of the work <br /> would substantially delay remediation and increase the <br /> cost of remediation activities on this site. Although <br /> Clearwater was not one of the original bidders , Neumiller <br /> & Beardslee has worked with Clearwater on numerous <br /> occasions and finds their work to be top notch. <br /> Clearwater has agreed to "step into the shoes" of RESNA to <br /> complete this phase of the work. <br /> Attached to this letter, in addition to the original <br /> bids from RESNA, McLaren Hart and Levin Fricke, please <br /> find a proposal for the feasibility study and corrective <br /> action plan portion of the •investigation phase on this <br /> site as proposed by Clearwater. As you will. note <br /> Clearwater has agreed to complete the work on this site at <br /> roughly the same cost that RESNA would have charged to <br /> complete this phase . <br /> Ruiz Grocery appreciates your review and consideration <br /> on this project. Ruiz Grocery would like Clearwater to <br /> complete the investigation phase--ie. the feasibility <br /> study and the Problem Assessment Report/Corrective Action <br /> Plan for this site.
