SAN JOAQUIN Environmental Health Department
C010NTY-
c n' Greotness grows herk;. Time In: 1:00 pm
Time Out: 1:50 om
Food Program Complaint Inspection Report
Name of Facility: DENNYS RESTAURANT#6686 Date: 11/06/2019
Address: 5033 S HWY 99 , STOCKTON 95215
Owner/Operator: BALLEW GILBEAU, MELINDA SUSAN ETAL Telephone: (209)937-0665
Program Element: 1600-FOOD PROGRAM Complaint#: C00051048
DESCRIPTION OF COMPLAINT ALLEGATIONS
The San Joaquin County Environmental Health Department received the following complaint:
NIGHT COOK DOES NOT WEAR A HAIR NET OR GLOVES WHILE COOKING. COMPLAINANT ORDERED A PHILLY
CHEESE STEAK WITH NO VEGGIES. SANDWICH WAS BROUGHT TO THE COMPLAINANT WITH VEGGIES AND
COMPLAINANT SENT IT BACK.WHEN THE WAITRESS TOOK IT BACK TO THE COOK HE SAID THERE WASN'T
VEGGIES IN IT AND THE WAITRESS SHOWED UP THERE WAS BELL PEPPERS.THE COOK THEN GRABBED THE
BELL PEPPER WITH HIS HANDS AND SAID THIS IS WHAT IT COMES WITH AND PUSHED THE PLATE BACK.THE
COMPLAINANT THEN TOLD THE COOK THAT HE COULD KEEP THE SANDWICH FOR HIMSELF AND THAT THEY
WANTED A NEW SANDWICH SINCE HE TOUCHED IT. THE COOK GOT UPSET AND WALKED OUT TO SMOKE A
CIGARETTE.WHEN HE FINISHED HE CAME BACK INSIDE AND STARTED COOKING AGAIN WITHOUT WASHING
HIS HANDS. COMPLAINANT IS CONCERNED OVER HIS LACK OF FOOD SAFETY.
VIOLATIONS AND CORRECTIVE ACTIONS
Items listed on this report as violations do not meet the requirements set forth in the California Health and Safety Code commencing with section 7;
113700.All violations must be corrected within specified timeframe. Violations that are classified as"MAJOR"pose an immediate threat to public health
and have the potential to cause foodborne illness. All major violations must be corrected immediately.Non-compliance may warrant immediate closure of
the food facility.
OVERALL INSPECTION NOTES AND COMMENTS
FOOD ITEM--LOCATION--TEMP°F--COMMENTS
No Temperature Data Collected
NOTES
Upon arrival, I spoke with the manager on duty to see if he had any knowledge in regards to the complaint. Manager stated
having no knowledge of a complaint being made of this manner from his staff or from other managers. He began to discuss
that he is a night manager for Thursday-Sunday, and stated having no knowledge of any members of his night staff who
possibly smoke cigarettes. I observed the crew working at this time in the kitchen and all are wearing hats to retain their hair.
Observed that the cooking line is secluded in a portion of the kitchen and any staff who enter into that cooking line wash their
hands before touching anything else. The hand washing station is covered, so any guest would not be able to see if any cooks
wash their hands before cooking or not. Manager and staff stated that any food that is returned to the back is thrown out and
a new plate is prepared, unless the customer wanted an adjustment made to their current dish.Advised manager to retrain
properfood safety techniques and to advise other managers not on duty as well.
Observed no violations at this time.
Official inspection report emailed.
The person in charge is responsible for ensuring that the above mentioned facility is in compliance with all applicable sections of the California Health and
Safety Code.If a reinspection is required, fees will be assessed at the current hourly rate.
VUVvv
Received by: Name and Title: walt withers, asst. manager
EH Specialist: VICTOR ACEVEDO Phone: (209)468-0337
FA0005537 C00051048 SCO04 11/06/2019
EHD 16-23 Rev.06/30/15 Page 1 of 1 Food Program Complaint Inspection Report
1868 E.
