The following is an itemized list of aboveground petroleum storage act violations that <br /> have not been addressed for TCI LEASING AND RENTAL as of July 08, 2019. <br /> Open violations from September 26, 2018 inspection <br /> Violation#102-Failed to prepare a written SPCC Plan in accordance with CFR Part 112. <br /> This facility has an Aboveground Petroleum Storage Act(APSA)regulated shell capacity of over 10,000 gallons. A <br /> Spill Prevention, Control, and Countermeasure(SPCC)Plan was not available on site. All facilities which have an <br /> APSA regulated shell capacity of 1,320 gallons or greater shall prepare a written SPCC Plan which meets all of the <br /> requirements of the 40 CFR Part 112. This plan shall be certified by a professional engineer in accordance with 40 <br /> CFR 112.3(d). Immediately prepare a SPCC Plan in accordance with 40 CFR Part 112,which that includes all <br /> aboveground petroleum storage containers 55 gallons or larger. Submit a copy of the Professional Engineer(PE) <br /> certified SPCC Plan to the EHD for review. (This copy will be returned to the facility after review.) A copy shall be <br /> maintained on site at all times. <br /> Violation#4010-Unlisted Administration/Documentation violation. <br /> HSC 25404(e)(4)-Facility is not reporting APSA business activities under California Environmental Reporting <br /> System (CERS). No later than three years after the statewide information management system is established, each <br /> CUPA, PA, and regulated business shall report program data electronically. Update the business activites section <br /> and under the"Does your facility own or operate aboveground tanks or containers with regulated storage greater <br /> than 1,320 gallons of petroleum products(new or used)?"question mark"Yes" <br /> Note: You can meet APSA state reporting requirements by uploading a tank facility statement or by submitting a <br /> hazardous materials business plan. To upload a tank facility statement, select the Browse button (in CERS APSA <br /> Program), locate the file on your computer to upload, provide a document title, and then select Save&Finish. <br /> To meet the requirement by submitting a business plan,you must submit the Facility Information, Hazardous <br /> Materials Inventory, Site Map and Emergency Response and Training Plans submittal elements through CERS. To <br /> indicate that you are using your business plan to meet the APSA reporting requirement, select the Provided <br /> Elsewhere in CERS document option, select Hazardous Materials Inventory, then click the Save button. <br /> Facilities subject to APSA shall keep a copy of their SPCC plan onsite in the facility is normally attended at least four <br /> hours per day, or at the nearest field office if the facility is not so attended. <br /> SPCC Plans are NOT required to be uploaded into CERS and,therefore, SPCC Plans should NOT be uploaded into <br /> CERS. <br /> Page 1 of 1 <br />
