The 25 September letter included copies of the 1) Waste Discharge <br /> Requirements for General Order for Discharge to Surface Waters of Groundwater Cleanup of Petroleum <br /> Fuel Pollution; 2) General Order for Land Disposal of Groundwater or Surface Water from Cleanup of <br /> Petroleum Pollution; 3) Form 200 Report of Waste Discharge; and 4) Section 2200 Annual Fee <br /> Schedules. Regional Board staff did not receive a Report of Waste Discharge. <br /> On 30 December 2003, Regional Board staff sent you another letter stating, "If a National Pollutant <br /> Discharge Elimination System or Waste Discharge Requirements permit is needed to implement the <br /> interim remedial measure,H&H Marina must submit Form 200 and all necessary information to <br /> Regional Board staff no later than 16 January 2004." On 16 January 2004, Advanced <br /> GeoEnvironmental, Inc. (AGE) on your behalf submitted Request for Extension, which requested an <br /> extension of the Report of Waste Discharge submittal due date. Our 21 January 2004 letter denied this <br /> request and referred to my 5 June 2003 letter stating that not conducting any remedial activities at the <br /> site is unacceptable and remedial activities must be a priority to prevent continued releases of petroleum <br /> .pollution into surface waters, which are a violation of Federal law. <br /> On 9 February 2004, Regional Board staff received Attachment "A" to General Order No. 5-00-119 <br /> (Letter) from AGE. The Letter does not state that it was submitted on your behalf, and was not <br /> accompanied by the application fee of$1,800 or the Form 200. The Letter does not constitute a <br /> complete Report of Waste Discharge and is inadequate because it does not include a detailed operations <br /> and maintenance plan, tables to show calculations of estimated carbon breakthrough, how AGE <br /> California Environmental Protection Agency <br /> CO Recycled Paper <br />
