(AGE) <br /> on behalf of Herman&Helen's Marina(H&H Marina) at 15 13 5 Eight Mile Road in Stockton. The <br /> Letter requests an extension of the current deadlines for the submittal of Form 200 Report of Waste <br /> Discharge (Form 200), the Annual Report, and the Site Assessment Report. <br /> The Letter states that the extensions are needed due to "additional work plans, expanded site assessment, <br /> and report preparation." The last report submitted on behalf of H&H Marina, the feasibility study work <br /> plan (FSWP), was received on 5 December 2003, which is seven weeks after the original requested <br /> deadline. Prior to this FSWP was the third quarter monitoring report in November and the <br /> 30 September 2003 Work Plan Addendum —September 2003. This report submittal schedule does not <br /> support the rationale provided for the requested extensions. Furthermore, additional work plans were <br /> requested due to inadequacies in the original submittals. Lastly, Form 200 was originally provided to <br /> you in September 2003,which was more than sufficient time to submit the necessary information. <br /> The Annual Report is a requirement listed in Monitoring and Reporting Program (MRP)No. 5-01-835, <br /> which is a Regional Board Order. We cannot provide an extension to this deadline. Regional Board <br /> staff addressed the issue of monitoring report deadlines, as specified in the MRP, in an <br /> 18 November 2002 email to AGE. <br /> Regional Board staff concurs with the extension for the Site Assessment Report because this is the first <br /> deadline extension request. Therefore, the Site Assessment Report is now due by 17 February 2004. <br /> The Regional Board's Executive Officer sent you a letter on 5 June 2003 which stated, "Remedial <br /> activities must be a priority to prevent continued releases of petroleum pollution into surface waters, <br /> which are a violation of Federal law." No remedial measures have been initiated, and this is <br /> unacceptable. As stated in our 11 August 2003 letter, groundwater extraction will work as an interim <br /> measure to prevent further plume migration, especially to the surface water.
