The Comment Letter was submitted by Advanced
GeoEnvironmental, Inc. (AGE) on behalf of the H&H Marina (H&H) located at 15135 Eight Mile
Road in Stockton (Site).
Central Valley Water Board staff sent H&H a draft Cleanup and Abatement Order (CAO) for
the Site on 3 December 2009. H&H's comments on the draft CAO included requests to
(1) clarify parcel numbers, (2) name previous and current property owners and operators,
(3) revise investigation and reporting due dates, and (4) submit a Feasibility Study (FS) for a
site remediation alternative. Central Valley Water Board staff responded to H&H's comments,
revised the draft CAO to name additional responsible parties, and sent out the revised draft
CAO on 11 March 2010 to all the named parties. The Comment Letter responds to the revised
draft CAO.
The most prominent comments in the Comment Letter
• Disclosed that a transfer of the H&H Marina property to a Nevada Corporation identified
as Delta Trucking was imminent,
• Repeated H&H's requests to name additional previous, current, and future property
owners in the CAO,
• Requested that operation of the groundwater treatment system be delayed until the
previously suggested feasibility studies could be completed,
• Requested a meeting to discuss implementation of the proposed feasibility study, and
• Stated that any additional work is subject to availability of funding.
In response to H&H's request for a meeting, Central Valley Water Board staff contacted H&H's
attorney and consultant via email on 12 April 2010 with possible dates for a meeting. The
meeting was held on 18 May 2010 and was attended by Mr. David Johnson, new lessee and
potential buyer of H&H Marina; Mr. George Hartmann, attorney for H&H Marina; and
Mr. Arthur Deicke and Mr. Robert Marty of AGE, consultants to H&H Marina.
California Environmental Protection Agency
crecycled Paper
