CLEANUP AND ABATEMENT ORDER2010-XXXX -5- <br /> BUSTEZ ENTERPRISES,INC.H&H MARINA PROPERTIES,LLC,AND HERMAN AND HELEN'S MARINA,INC <br /> H&H MARINA,15135 EIGHT MILE ROAD, STOCKTON,SAN JOAQUIN COUNTY <br /> REQUIRED ACTIONS <br /> IT IS HEREBY ORDERED that, pursuant to California Water Code sections 13304 and <br /> 13267, and Health and Safety Code section 25296.10, the Bustez Enterprises, Inc. and <br /> H&H Marina Properties, LLC shall: <br /> 1. Immediately investigate the discharges of waste, clean up the waste, and abate the <br /> effects of the waste resulting from activities at the H&H Marina at 15135 Eight Mile Road, <br /> Stockton, San Joaquin County in conformance with State Water Board Resolution <br /> No. 92-49 Policies and Procedures for Investigation and Cleanup and Abatement of <br /> Discharges Under Water Code Section 13304 and with the Central Valley Water Board's <br /> Water Quality Control Plan for the Sacramento River and San Joaquin River Basins (in <br /> particular the Policies and Plans listed within the Control Action Considerations portion of <br /> Chapter IV). Compliance with this requirement shall include, but not be limited to, <br /> completing the tasks listed below by the dates listed. <br /> 2. All work shall be conducted under permits required by State, County, and/or Local <br /> agencies. <br /> 3. The Dischargers are required to submit, under penalty of perjury under the laws of the <br /> State of California, the following technical reports and implement the following actions by <br /> the dates listed below. <br /> Submit a complete Notice of Intent 5 May 2010 <br /> Submit an NOI to enroll in NPDES General Order No. R5-2008- <br /> 0085. <br /> Groundwater Monitoring Report 1 May 2010 <br /> Submit the first quarter2010 quarterly monitoring report required by <br /> MRP No. R5-2009-0833. <br /> Implement Approved'Remedial Actions 26 May 2010 <br /> submit a work plan to complete the borings, well installations, and <br /> remediation system upgrades as proposed in H&H's 13 February <br /> 2009 Additional Site Assessment Report.. <br /> Resume',operation of the groundwater treatment system 26 May 2010 <br /> Operate and report on the remediation system according to the <br /> requirements of NPDES General Order No. R5-2008-0085. <br /> GROUNDWATER MONITORING <br /> 4. Conduct monitoring of the existing wells and any additional wells in accordance with <br /> Monitoring and Reporting Program (MRP) No. R5-2009-0833 or any revised MRP issued <br /> by the Executive Officer. <br />
