California Regional Water Quality Control Boardy==
Central Valley Region
Katherine Hart, Chair
11020 Sun Center Drive,#200, Rancho Cordova,California 95670-6114
Linda S.Adams (916)464-3291 • FAX(916)464-4645 Edmund G.Brown Jr.
http://www.waterboards.ca.gov/centralvalley Governor
Acting Secretary for
Environmental Protection RECEIVED
8 March 2011 MAR 11 2011
Mr. James A. Levy, Manager
Environmental Site Remediation ENVIRONMENTAL HEALTH
Union Pacific Railroad Company PERMIT/SERVICES
9451 Atkinson Street, Suite 100
Roseville, CA 95747
NO FURTHER ACTION DETERMINATION, UNION PACIFIC RAILROAD COMPANY,
STOCKTON YARD DIESEL SPILL, SAN JOAQUIN COUNTY
Union Pacific Railroad (UPRR) operates a rail yard at 833 E. 8th Street in Stockton (Site). Site
activities resulted in petroleum hydrocarbon (TPH) contamination in soil and surface water.
As the attached Memo to Antonia Vorster, the Site Cleanup Program Manager indicates,
UPRR implemented emergency measures, excavated soil and replaced a culvert to remove
the TPH from site surface water and soil. The Regional Water Board concurs that remaining
TPH does not pose a threat to human health, the environment, or waters of the State.
UPRR has satisfactorily completed site investigation and remedial action, achieved applicable
remedial action standards and objectives, and a permanent remedy has been accomplished at
833 E. 8th Street in Stockton. Therefore, no further action is required.
Issuance of a No Further Action Determination does not preclude future action by the Water
Board if subsequent monitoring, testing, or analysis of 833 E. 8th Street indicates that the
remedial action standards and objectives were not achieved; a new or previously
undiscovered release occurs at 833 E. 8th Street; or new information indicates that further site
investigation and remedial action are required to prevent a significant risk to human health and
safety, the environment, or water quality; or if UPRR induced the Water Board to issue this No
Further Action Determination by fraud, negligent, or intentional nondisclosure or
misrepresentation.
If you have questions about this letter, you may call Gerald Djuth at (916) 464-4677. Please
note that staff oversight charges for work associated with this no further action letter will be
billed on the first quarter 2011 invoice, in the same manner as previously billed.
PAMELA C.
