Spill Prevention, Control and Countermeasure Plan <br /> Tesla Treatment Facility Page I of 45 <br /> 1.0 APPLICABILITY AND DEFINITIONS FOR ALL FACILITIES <br /> AND TYPES OF OIL [40 CFR§112.1 THROUGH 40 CFR§112.61 <br /> This Spill Prevention, Control and Countermeasure Plan (SPCC Plan) was prepared by LEE <br /> Incorporated (LEE) for the San Francisco Public Utilities Commission (SFPUC), Water Supply <br /> and Treatment Division (WSTD). The SPCC Plan is for the Tesla Treatment Facility located at <br /> 9000 W. Vernalis Road in Tracy, San Joaquin County, California 95377. <br /> Figure A-1 in Appendix A is a site vicinity map. <br /> 1.1 Purpose <br /> The purpose of the SPCC Plan is to update the use, handling and storage practices of oil' at the <br /> Tesla Treatment Facility; describe the practices intended to prevent spills from occurring;provide <br /> for safe, effective and timely response to spills should they to occur; and mitigate the impact of <br /> spills on human health, the environment, and navigable water bodies. In the unlikely event of an <br /> oil discharge, this SPCC Plan provides spill prevention, control and countermeasures applicable <br /> to the facility. <br /> This SPCC Plan was prepared to meet Part 112 of the Code of Federal Regulations Title 40 (40 <br /> CFR§112) - Oil Pollution Prevention (SPCC Rule), and the California Aboveground Petroleum <br /> Storage Act (APSA). The state's APSA regulates tank facilities that have a storage capacity of <br /> 1,320 gallons or more of petroleum hydrocarbon product. Because the aggregate aboveground <br /> petroleum product storage tank capacity exceeds 1,320 gallons, the Tesla Treatment Facility is <br /> subject to APSA and required by the state to develop and implement a SPCC Plan. In January <br /> 2008, California Assembly Bill 1130 transferred the responsibility for the implementation, <br /> enforcement and administration of APSA from the State Water Resource Control Board(SWRCB) <br /> to the local Certified Unified Program Agency(CUPA). The San Joaquin County Environmental <br /> Health Department(SJCEHD) is the CUPA for facilities located in San Joaquin County. <br /> 1.2 General Applicability Requirements [40 CFR§112.11 <br /> This SPCC Plan was developed to meet the federal SPCC Rule and state APSA by providing <br /> facility-specific guidance for the prevention, control and countermeasure of oil discharge. Section <br /> 40 CFR§112.1 addresses the general applicability of the SPCC Rule. <br /> 1.2.1 General Applicability [40 CFR§112.1(a)] <br /> The SPCC Rule establishes procedures,methods, equipment and other requirements to prevent the <br /> discharge of oil from facilities into or upon navigable waters of the United States or adjoining <br /> shorelines, or into or upon the waters of the contiguous zone, or that may affect natural resources <br /> belonging to, appertaining to, or under the exclusive management authority of the United States. <br /> ' Oil in this SPCC Plan is defined as per Part 40 CFR§112-Oil Pollution Prevention(SPCC Rule)to mean any kind <br /> or in any form,including,but not limited to: fats,oils or greases of animal,fish,or marine mammal origin;vegetable <br /> oils including oils from seeds,nuts,fruits or kernels;and other oils and greases,including petroleum,fuel oil,sludge, <br /> synthetic oils,mineral oils,oil refuse,or oil mixed with wastes other than dredged spoil. <br />
