Mike Infurna [EH]
From: Mike Infurna [EH]
Sent: Monday, November 07, 2011 9:38 AM
To: rmarty@advgeoenv.com'
Subject: RE: 520 North EI Dorado Street, Stockton
Bob,
I do NOT want to be Subpoena'd for this after I retire. You know as well as I do,
landowners are not always clear on what happens if a third party/buyer drills and
finds significant contamination. Typically the 'buyer' bails and the owner is left
with a documented 'contaminated' site. They get our letters and then they get
unhappy. Their land is devalued and they blame the EHD. They whine they
didn't 'realize' that they would be 'stuck' with this 'problem' and now NO ONE
wants to buy our land or if they do, at a much reduced price. At any rate,
lawyers get involved and suing the County seems like a deep pocket, guaranteed
return.
So whomever is representing the landowner realizes the potential impact of what
granting access means, I'm ok with it/this doe. You see my point? Anyway to
clear this up w/o a big hulabaloo?
Can some one get us some assurances that everyone is prepared/ok with what
could happen in the worst case (lots of contamination found) ?
I'll take an email from the landowners' representative. I don't need this stress on
a simple env assmt.
From: Robert E. Marty [mailto:rmarty@advgeoenv.com]
Sent: Monday, November 07, 20119:04 AM
To: Mike Infurna [EH]
Cc: Rebecca Natal
Subject: RE: 520 North EI Dorado Street, Stockton
Yeah, I wished they'd used MY agreement -- but the current owner, Mr. Warner, is in the
hospital and "terminal" from my understanding; that is why his wife, via their attorney,
signed it (Both Mr. and Mrs. Warner are on the property).
They (the Warners) want the property sold. I don't think Mrs. Warner wants to deal with
this. And, we are dealing with brokers and attorneys whom do not fully understand the
intricacies of the boring process and EHD.
If there is any way the existing signature will work, please let me know. I don't really
11/7/2011
