In determining whether a violation is <br />chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br />violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br />corrective action). <br />The 87A and 91 octane sensor failed to activate an audible and visual alarm at the panel when tested to ensure <br />continuous monitoring of the tank system. All monitoring equipment shall be maintained to activate an audible and visual <br />alarm or stop the flow of product at the dispenser when it detects a leak. Correct immediately by having a properly <br />licensed, trained, and certified contractor replace the failed component with a functional component (LG113 listed, if <br />applicable) and obtain a permit within one business day from the EHD. If the failed component can't be replaced <br />immediately, there is a possibility that the 87A and 91 -grade UST system may be red tagged to prevent fuel inputs.
