Cherokee Lane Lodi, CA 95240 <br /> The San Joaquin County Environmental Health Department (EHD) has performed a service <br /> request inspection with your contractor Elite IV at your facility on the underground storage tank <br /> (UST) system at the above noted address on February 18, 2010. <br /> A new wireless Incon TS-5000 monitoring panel was installed along with Incon Leak Detectors <br /> inventory probes and Incon liquid detection sensors. <br /> When Elite IV needed to turn on the diesel turbine to verify positive shutdown, it was found that <br /> there was not enough fuel in the tank to do so. The facility employees stated the diesel tank <br /> has not been in use for approximately the last three months due to a malfunctioning dispenser, <br /> and that diesel would not be sold until the dispensers are replaced. There has been no diesel <br /> delivery fuel to the tank since the dispensers has been taken out of service. <br /> Under Health and Safety Code Chapter 6.7 Section 25298, no person shall temporarily cease <br /> operating an underground storage tanks (UST) system. <br /> Under California Code of Regulations Title 23, Section 2671 allows for the temporary closure of <br /> UST in which storage of hazardous substance has ceased but the UST will be again be used for <br /> the storage of hazardous substance within the next 12 consecutive months. <br /> Time period between cessation of hazardous substance storage and application for temporary <br /> tank closure shall not exceed 90 calendar days. The facility employees stated the diesel tank <br /> has not been in used since November 2009. Immediately submit an application for a temporary <br /> closure of UST along with a copy of the written approval obtained from the Lodi Fire Department <br /> to EHD. <br />
