El Dorado Street Stockton CA <br /> Attached site map <br /> Dear Mr. Fannos: <br /> As you are aware, Chevron has been involved in environmental investigation and remediation <br /> activities at the subject site. Our involvement is required as part of our responsibilities to the <br /> property owner, Mr. Ramon Guerrero, to the Central Valley Regional Water Quality Control <br /> Board, and to the local regulating agency, San Joaquin County Public Health Services (SJCPHS). <br /> Recent construction performed by your company at the subject site has rendered two of our four <br /> groundwater monitoring wells inaccessible. As a result, Chevron cannot meet its responsibility to <br /> the property owner and is out of compliance with the regulating agencies. <br /> In August 1992, you surveyed the subject site with Mr. Harlin Knoll of the SJCPHS. During this <br /> survey all groundwater monitoring wells were identified onsite (see attached) and it was <br /> determined that none would interfere with site development plans. On January 15, 1993 I was <br /> informed that monitoring well MW-1 was inaccessible due to site construction. On February 17, <br /> 19931 met with you onsite to confirm that MW 1 was covered by cement At that time, I explained <br /> Chevron's intent to properly abandon the well and that we would pay all costs associated with <br /> cutting the cement for access. On February 19, 1993 1 faxed a copy of the well survey <br /> measurements that would enable you to accurately cut the cement for access. During March 1993, <br /> you told our consultant, Groundwater Technology, that you would coordinate the well <br /> abandonment work with them as soon as the well was accessible. After several failed attempts at <br /> locating MW-I with a backhoe, you called me in September, 1993 to report that the well could not <br /> be found. Later in September, you met with Harlin Knoll onsite to verify(again) that MW 1 was <br /> buried under the concrete. During that meeting, Mr. Knoll expressed his concern to you that the <br /> remaining onsite wells(MW-2 and MW-3) would have to be adjusted to accommodate the planned <br /> surface paving. After Mr. Knoll notified me of this, I made several attempts to contact you to <br /> coordinate an adjustment of our wells prior to the paving of the property. You returned none of my <br /> calls or messages and the property was paved and monitoring well MW-2 was covered with <br /> asphalt. <br /> The access of well MW-2 is essential to our environmental investigation. Chevron plans to measure <br /> groundwater conditions at the subject site during the first quarter of 1994. In order to do so, we <br /> would appreciate your full cooperation in providing access to this well before February 28, 1994. <br /> In addition, since diligent efforts were made by Chevron to prevent the paving of MW-2, it would <br /> _1 <br />
