El Dorado ) <br /> - - Stockton, CA - } <br /> Pursuant to Health and Safety Code Section 42351, the above named Petitioner filed a <br /> petition for a 41 day interim variance with the Air Pollution Control Offi,er on <br /> March 29, 1991. The petition was duly considered by Alexander Scheflo acting for and <br /> on behalf of the Hearing Board. The District was represented by Lakhmir Grewal on <br /> behalf of Jogi Khanna, H.D , Air Pollution Control officer <br /> After receiving evidence and testimony, the following findings and decision were made <br /> FINDINC'S <br /> Good cause exists for the granting of an interim variance as is hereinafter more <br /> particularly set forth: <br /> Wickland Properties& <br /> 1. is in violation of Rule 201 of the San Joaquin County Air Pollution <br /> Control District. <br /> 2. Cannot comply with the above Rules and Regulations because of conditions <br /> beyond its control. <br /> 3. Forced immediate compliance would result in the closing of Wickland <br /> Properties and the elimination of a lawful business without corresponding <br /> benefit in reducing air contaminants <br /> 4. Wickland Properties has given consideration to curtailing operations of <br /> the source in lieu of obtaining a variance. <br /> 5. During the period the variance in effect, Wickland Properties will reduce <br /> excess emissions to the maximum extent feasible; and <br /> 6 (luring the period the variance is in effect, Wickland Properties will <br /> monitor or otherwise quantify emission levels from the source, if <br /> requested to do so by the district, and report these emission levels to <br /> the district pursuant to a schedule established by the district <br /> Therefore, the Board orders that Wickland Properties is hereby granted a 41 day <br /> Temporary Permit to Operate at the plant located in Stockton, San Joaquin County, <br /> California, ender the following terms and conditions, <br /> C <br />
