Sections 6 and 7 of the approved <br /> underground storage tank removal application(SR0069109)lists American Valley Waste Oil as <br /> the permitted hazardous waste hauler and permitted treatment, storage and disposal facility <br /> (TSDF)the tank residue will be hauled by and to. <br /> Stockpile remains onsite fiom the May 1,2014 underground storage tank removal. Condition 4 <br /> of the approved permit states"if the removed backfill material and/or soil is found to be <br /> contaminated it must be disposed of at an approved disposal location. Treatment of soil onsite <br /> can only be performed under a hazardous waste treatment permit" <br /> VIOLATION: <br /> Failure to remove residual sludge from the UST as a hazardous waste or recyclable <br /> material is a violation of California Code of Regulations 2672(b)(1). <br /> Failure to demonstrate the removal, disposal and neutralization of residual amounts of the <br /> hazardous substance(s) which were stored in the tank system prior to its closure is a <br /> violation of Health&Safety Code 25298(c) (1). <br /> CORRECTIVE ACTION: <br /> Immediately submit to this office a copy of the manifest showing residual sludge was <br /> disposed of as hazardous waste or recyclable material. <br /> Immediately submit a copy of the disposal record for the stockpile,or the hazardous waste <br /> treatment permit and a copy of the approved work plan from the EHD site mitigation unit. <br />
