Since December 1999, <br /> atotal ofthirty-six (36) consecutive quarterly groundwater monitoring events have been conducted <br /> at this site (see Tables 1 and 2). Based on the ground water monitoring data collected to date, there <br /> does not appear to be increasing trends in ground water concentrations and the ground water plume <br /> appears to be in a stable state. Therefore, AGE believes that continued quarterly ground water <br /> sampling from wells MW- 1 through MW- 12 for the investigation is not cost effective. Currently, <br /> AGE is in the process of preparing a corrective action plan (CAP). Until this site is operating a <br /> ground water remediation system (ifwarranted), annual sampling events should be adequate enough <br /> to monitor ground water impact at the site, and should be re-evaluated on a annual basis . <br /> As you are aware, costs associated with the cleanup effort at this site are presently reimbursed by the <br /> California State Water Resources Control Board (SWRCB) under the Underground Storage Tank <br /> (UST) Cleanup Fund. However, Van De Pol Enterprises was recently notified by the UST Cleanup <br /> Fund on 09 January 2009 that future reimbursements for this claim would be suspended indefinitely <br /> until funds become available. Due to the significant cost ofprevious quarterly monitoring at this site, <br /> Van De Pol Enterprises has accrued over $ 150,000 of expenses that has not been reimbursed by the <br /> UST Cleanup Fund. Furthermore, Van De Pol Enterprises has recently had three additional UST <br /> investigations suspended by the UST Cleanup Fund. These suspensions combined with the accrued <br /> cost of quarterly monitoring has caused a great financial hardship on Van De Pol Enterprises. <br /> Van De Pol Enterprises does not have the financial capabilities to continue absorbing costs with the <br /> ongoing quarterly ground water monitoring program. Therefore, AGE is requestingthat the quarterly <br /> ground water monitoring program be reduced to an annual monitoring program.
