rF -$
('However, I would again restate that as owners of this property
are: Eileen Rue, age S?, retired; Mary Jo Eustis, age 56 school teacher,
and Virginia Byford, age 53, registered nurse. All of inherited this
property (Virginia and Mary Jo twice removed) and had NO
knowledge of the existence of the 110 gal oil drainage tank. They are
not business people or automotive/mechanically minded. They rarely
visit the site. I would also remind you that when the tank was
removed evidence showed that the tank had not-been used for many,
many years.
The owners believe that they should not be penalized for
something that they did not even know existed and which had
apparently not been in use during their time of ownership. They feel
that they are being held hostage by the failure of your office to respond
to the appeal:letter.
We believe we are all on the same side of the fence on this
issue.....we all want to get this resolved.so that we can proceed with
completing this project. The owners are not looking for
confrontation...but rather to mutual resolution. If further negotiations
are necessary, I would be more than happy to meet with your
personally in order to do whatever it takes to move this project forward.
We thank you in advance for thoughtful consideration of our
appeal and look forward to hearing from you at your earliest
convenience.
I
Sincerely,
Robert N. Eustis,
Representing:
Eileen Rue,
Virginia Byford
Mary Jo Eustis
N CC: Virginia Byford, Eileen Rue
Sandy Gill, Claims Review Unit, SWRCB
Margaret Lagorio, SJC EHD
4
e
