In ardor <br /> (b) If Purchaser disapproves of the results of the environmental work, <br /> Purchaser may elect to terminate this Agreement and the escrow by giving Sellers <br /> written notification of Purchaser's election to terminate. All of Purchaser S deposited <br /> funds plus interim shall be retumed to Purchaser upon such termination. Sellers shall <br /> allow Purchaser to access the Property in order to perfbrm the environmental studies <br /> contemplated by paragraphs(a)and (b). <br /> (c) As a further condition precedent to closing, Sellers shall remove at their <br /> sale expense the c"in IInk fencing which extends around the perimeter of the <br /> Property. Sellers shall notify Purchaser when fencing is removed. <br /> (d) Purchaser upon being satisfied with the environmental condition of the <br /> property and being notilled by Sellers of the removal of the fencing shall no* the <br /> escrow holder that escrow is to clasm, <br /> ACCESS <br /> Pur0fifter and Purchasers contractors and consultants shall have the right, from <br /> the date of this Agreement until close of escrow, to enter onto the Property, at their own <br /> cost and risk, for any purposes, including but not limitad to, inspecting the Proparty, <br /> taking samples of the soil, and conducting an environmental audd (including an <br /> Investigatlon of post and current uses of the Property). In addition, Purchaser shall <br /> have the right to contact any federal, state, or local governmental authority or agency to <br /> Investigate any mattars relating to the Property. Sellers agree to cooperate reasonably <br /> with Purchaser in the inspection of the Property and agree to deliver to Purchaser all <br /> information in Sellers' possession or control pertaining to the condition of the Property, <br /> including engineering and environmental reports, studies, testa, monitoring results, and <br /> related documentation. <br /> TITLE <br /> (a) Immediately following the execution of this Agreement by both parties, <br /> Purchaser shall cause Esarow Agent to leaue to Purchaser (with a copy to Sellers) a <br /> preliminary report for a UTA owner's Policy for the Property, setting forth all liens, <br /> encumbrances, easementsT restrictions, conditions, pending litigation, judgments, <br /> administrative proceedings, and other matters affecting Sellers' title to the Property <br /> ("Preliminary Report"), together with copies of all documents relating to title exceptions <br /> referred to in the Prallminory Report. <br /> (b) Purchaser shall approve or disapprove each exception shown on the <br /> Prellminary Report and each encroachment, overlap, or boundary line dispute, or any <br /> other matter that materially and adversely afrects title to the Property or violates any <br /> law, male, or regulation reflected in the Preliminary Report (each err "Exception") within <br /> seven (7) days following the receipt of the Preliminary Report.
