The following is an itemized list of hazardous materials violations that have not been <br /> addressed for Cafe Rio Mexican Grill as of October 18, 2018. <br /> Open violations from August 30, 2018 inspection <br /> Violation #2 - Failed to complete and electronically submit a hazardous materials business plan. <br /> The facility's business plan was not submitted electronically to the California Environmental Reporting System <br /> (CERS). As of January 1, 2013, all businesses were required to submit all business plans electronically. <br /> Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to <br /> the EHD for approval. <br /> Violation #3 - Failed to establish and implement a hazardous materials business plan. <br /> A Hazardous Materials Business Plan has not been established or implemented. A Hazardous Materials Business <br /> Plan shall be established and implemented for emergency response to a release or threatened release of a <br /> hazardous material when storing hazardous materials at or above the thresholds quantities of 55 gallons for <br /> materials that are liquids, 500 pounds for solids, or 200 cubic feet for compressed gas, at standard temperature and <br /> pressure. Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, <br /> enter the required information, and submit for review by the EHD. <br /> Violation #6 - Failed to complete and/or submit a site map with all required content. <br /> A site map was not completed or submitted as part of the business plan. A site map shall contain a north <br /> orientation, loading areas, internal roads, adjacent streets, storm and sewer drains, access and exit points, <br /> emergency shutoffs, evacuation staging areas, hazardous material handling and storage areas, and emergency <br /> response equipment. If a site map element is not applicable for your facility then list it on the map and label as <br /> "NA". Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, <br /> upload the correct or updated information, and submit to the EHD for approval. <br /> Violation #7 - Failed to establish and/or submit emergency response procedures for a release or threatened <br /> release. <br /> The emergency response procedures were lacking or inadequate. A business plan shall include the following <br /> emergency response procedures for a release or threatened release of hazardous materials, including, but not <br /> limited to, the following: <br /> - immediate notification of local emergency personnel and the Environmental Health Department (EHD) <br /> - procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment <br /> -evacuation plans and procedures, including immediate notice, for the site <br /> Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the <br /> correct or updated information, and submit to the EHD for approval. <br /> Violation#8 - Failed to submit a training program or program is not reasonable or adequate for facility. <br /> A training program was lacking or insufficient. Training programs for all employees and annual training, including <br /> refresher courses, shall include safety procedures for the event of a release or threatened release of a hazardous <br /> material, including, but not limited to, familiarity with the facility's emergency response plans and procedures. These <br /> training programs may take into consideration of each employee. Immediately prepare or update the facility's <br /> training program, log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, <br /> upload the correct or updated information, and submit to the EHD for approval. <br /> Violation #9 - Failed to annually review and certify that the business plan is complete, accurate, and up to <br /> date. <br /> The business plan information has not been reviewed and resubmitted in the California Environmental Reporting <br /> System (CERS) annually. The hazardous materials inventory shall be submitted by January 15 of each calendar <br /> year and may be submitted beginning November 1 of the previous year. Immediately log into the CERS at <br /> http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br /> Page 1 of 2 <br />
