GENERAL CONDITIONS <br /> LAWS AND REGULATIONS: Contractor and all his agents and employees shall observe and comply with all prevailing federal and state <br /> laws, which in any way affect conduct of work of this contract. Contractor shall, at his expense,obtain all permits,licenses and insurance <br /> and shall maintain all required protection for property, employees and the public. Neither the state nor the contractor is subject to <br /> municipal, county or district laws, rules, or regulations pertaining to building permits or regulating the design or construction of buildings <br /> upon state property. - <br /> WAGE RATES: Pursuant to Section 1770 of the Labor Code, the Department has ascertained the general prevailing rate of wages in the <br /> county in which the work is to be done, to be as listed in a Department of Transportation publication entitled Equipment Rental Rates and <br /> General Prevailing Rates, dated same month as bid proposal,and which has been adopted by the Department of General Services.Copies of <br /> this publication are on file at 1500 — 5th Street, Sacramento, California and Department of Industrial Relations, and are available to any <br /> interested parry on request Comply with Labor Code Section 1775. - <br /> LABOR DISCRIMINATION: Comply with Labor Code Section 1735. <br /> HOURS O F LABOR: Eight hours of labor constitutes a legal day's work.Work performed by employees of contractors in excessof 8 hours <br /> per cry, and 40 hours during any one week, shall be permitted upon compensation for all hours worked in excess of 8 hours per day at not <br /> less than one and one-half times basic rate of pay,as provided in Section 1815 of the Labor Code. <br /> APPRENTICES: Pursuant to Sections 1777.5 and 1777.6 of Labor' Code, and in accordance with regulations of California <br /> Apprenticeship Council (see Title 8, California Administrative Code,Sections 18000 et seq) and local apprenticeship standards for the craft <br /> or trade, properly indentured apprentices may be employed in prosecution,of work. Information relative to apprenticeship standards,wage <br /> schedules, and other requirements may be obtained from the Director of Industrial Relations,ex officio the administrator of apprenticeship, <br /> State Building Annex,455 Golden Gate Avenue,San Francisco,or from the Division of Apprenticeship Standards and its branch offices. <br /> TRAVEL AND SUBSISTENCE PAYMENT: The contractor shall pay travel and subsistence payments to each workman needed to execute <br /> the work as such travel and subsistence payments are defined in the applicable collective bargaining agreements filed with the Department of <br /> Industrial Relations pursuant to Labor Code Section 1773.8. <br /> WORKMEN'S COMPENSATION: In accordance with provisions of Section 3700 of Labor Code, contractorwill be required to secure <br /> payment of Workmen's Compensation to his employees and pay all costs thereof, <br /> FAIR EMPLOYMENT PRACTICES: Pursuant to Governor's Cade of Fair Practices, provisions pertaining to fair employment practices, <br /> attached,are incorporated into this contract and contractor agrees to follow such provisions. <br /> AIR POLLUTION CONTROL: In accordance with Section 14381 of the Government Code, each contractor shall comply with all air <br /> pollution control rules, regulations, ordinances, and statutes which apply to any work performed pursuant to the contract,including any air <br /> pollution control rules,regulations,ordinances,and statutes specified in Section 11017 of the Government Code. <br /> BID BONDS: Bid Bonds are not required where the estimate of cost is less than $15,000.00. All Bids in excess of $15,000.00 will require <br /> Bid Bonds <br /> PAYMENT BONGS: Per.Civil Code Section 3247, Payment Bonds in the amount of 50%of the contract are required on every project in <br /> excess of $15,000.00. <br /> PERFORMANCE BONDS: Required on all projects under the State Contract Act, in the amount of 50% of the contract when contract i,- <br /> in <br /> sin excess of $15,000.00. When the contract is less than $15,000.00 and there is a lump sum payment, and no progress or partial payment: <br /> to be made, this Bond is not required. - <br /> INDEMNIFICATION: The contractor agrees to indemnify and save harmless the State, its officers,agents and employees from any and all <br /> claims and losses accruing or resulting to any and all contractors, subcontractors, materialmen, laborers and any other person, firm or <br /> corporation furnishing or supplying work, services, materials or supplies in connection with the performance of this contract,and from any <br /> and all claims and losses accruing or resulting to any person, firm or corporation who may be injured or damaged by the contractor in the <br /> Performance of this contract. The contractor shall provide necessary workman's compensation insurance at contractor's own cost and <br /> expense. <br /> CONTROL OF WORK BY STATE:The State Architect, acting either directly or through properly authorized agents, is in charge of work <br /> covered in these specifications He shall decide all questions which may arise as to the quality or acceptability of materials furnished and <br /> work performed; all questions which may arise as to the interpretation of the plans and specifications;and all questions as to the acceptable <br /> fulfillment of the contract an the part of the contractor. .. <br /> GUARANTEE: All materials and workmanship to be furnished and performed under this specification shall be fully guaranteed against <br /> defects for a period of (1) year after date of acceptance of the contract, unless otherwise specified.Signature on contract documents shall <br /> constitute guarantee. <br /> CARE AND PROTECTION: The contractor shall be entirely responsible for any damage to the property due to hauling or other causes <br /> attributable to this work and,upon completion of the work,leave the premises in a clean condition. <br /> SMALL BUSINESS: Preference will be granted to bidders properly prequalified as "Small Business" in accordance with Section 1896 et. <br /> seq.,Title 2,California Administrative Code. <br />
