KEEN <br />OF COUNSEL <br />RECF��I �L <br />SEP 1 6 2005 <br />ENVIRONMENI HEpLTf,, <br />PERMIT/SERVICES <br />In response to your letter of September 12, 2005, and to clarify and otherwise "fill in the <br />gaps" in said letter. <br />1) Ronald Marchetti is deceased; <br />2) The owners evicted the tenant, Rafael Limon, individually & dba "Rafael Lopez <br />Trucking" on or about June 21, 2005. <br />3) The tires were either those of the tenant and/or third parties who abandoned the tires at <br />the site. These facts were conveyed to Ted Tasiopoulos, Sr. on several occasions and by several <br />different individuals. Mr. Tasiopoulos advised that a named tire hauler may be responsible for these <br />and other tires abandoned at other sites. Mr. Tasiopoulos stated he would be investigating. <br />4) As you may or may not know, on or about September 8, 2005, I spoke with Mr. <br />Tasiopoulos who advised the September 26, 2005 hearing may be canceled if the tires are removed <br />before September 26, 2005. I requested information on the status of the investigation and a copy of <br />any written documentation as to the responsible parties possibly including the tenant and/or tire <br />hauler. I do so again. As you are also well aware, the removal of these tires requires properly <br />certified tire haulers. I expect the remainder of the tires will be removed within the week. Again, <br />to emphasize, my clients have been required, out of their own pockets, to pay for the removal of tires <br />that EHD knows were illegally dumped by known or suspected third parties. <br />
