A closure <br /> request with all documentation was submitted on August 13,2003 by Ground Zero Analysis on <br /> behalf of Souza II LLC. <br /> It is my understanding that Mr. John Lane of Ground Zero Analysis followed-up on this <br /> request with a telephone call to you on September 9,2003 and again on September 18,2003. It <br /> is also my understanding that on both occasions you indicated that you had not yet reviewed this <br /> matter,either yourself or with Mir. Henderson of your office which was a prerequisite to <br /> discussing the project with the Regional Water Quality Control Board,namely James Barton. <br /> I am personally familiar with the fact that a closure request was submitted weeks after <br /> this request,to the same office,and meetings have already taken place with the Regional Water <br /> Quality Control Board on that site. I am also aware that Mr. Lane, at my request,has contacted <br /> you on September 23,2003,regarding a face-to-face meeting with respect to the Souza property, <br /> and that the earliest possible date that you could schedule a meeting was October 22,2003. All <br /> of this on a site where there is no deep soil contamination and no MTBE,and BTEX are below <br /> drinking water standards. <br /> This commercial real estate development in Tracy has indemnities that run to Mr. Souza <br /> that need to be cleaned as soon as practically possible. The client and myself are deeply <br /> disturbed at these delays. I would hope that this matter could receive some attention prior to <br />
