CONDITIONS OF APPROVAL <br /> PA-1900010 (MS) <br /> RICHARD AND FRANCES BOZZANOIDILLON AND MURPHY <br /> Minor Subdivision Application No. PA-1900010 was approved by the Community Development <br /> Department on June 7, 2019. The effective date of approval is June 17, 2019. This tentative map <br /> approval will expire on June 16.2022,which is three(3)years from the effective date of approval,unless <br /> (1) all Conditions of Approval have been complied with and (2) a Parcel Map has been filed with and <br /> accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as ordinance requirements pertinent to this application. Ordinance requirements cannot be <br /> modified and other ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Giuseppe Sanfilippo [209]468-0227) <br /> a. TENTATIVE MAP: The Parcel Map shall substantially conform with the approved tentative map dated <br /> January 24, 2019. <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b),the following note shall <br /> be placed on the Final Map and recorded as a separate instrument: <br /> All persons purchasing parcels within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, such as <br /> noise, odors, insects, dust or fumes. San Joaquin County has determined that such inconveniencies <br /> or discomforts shall not be considered to be a nuisance. <br /> c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot width of 330 feet, measured at the front yard setback line. <br /> (Development Title Section 9-610.4) <br /> (2) All parcels shall have a minimum lot area of 22.7 gross acres(Variance application PA-1800216) <br /> d. ACCESS: The following requirements apply and shall be shown on the Parcel Map: <br /> (1) A proposed 25-foot wide private easement for access to Parcel Two, along Parcel One, shall be <br /> shown on the Parcel Map. (Development Title Section 9-1150.15) <br /> (2) The following note shall be placed on the Parcel Map and also shall be recorded as a separate <br /> instrument: <br /> At the time of non-agricultural development of Parcel Two, the entire length of the private right-of- <br /> way for parcel Two shall be constructed and maintained to the standards required by the California <br /> Fire Code and applicable San Joaquin County Improvement Standards. (Development Title <br /> Section 9-1150.15[c]) <br /> 2. COUNTY COUNSEL <br /> a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and <br /> employees from any claim, action, or proceeding against the local agency or its agents, officers, or <br /> employees to attack,set aside,void, or annul an approval of the local agency,advisory agency,appeal <br /> board, or legislative body concerning a subdivision, which action is brought within the time provided <br /> for in Section 66499.37 of the Government Code. <br /> PA-1900010 (MS) Conditions of Approval 1 <br />
