A noise study was conducted by J. C. Brennan and Associates dated January 23, 2018. The noise <br /> analysis included conducting a staged concert. J.C. Brennan and Associates set up a sound system on <br /> the stage area which is oriented in the direction of typical music. In addition, the music was piayed at an <br /> amplitude that is generally typical of outdoor events. <br /> The noise study analyzed the noise level at three (3) noise measurement sites while music was playing, <br /> and concluded the winery can comply with the county noise level standards provided the events terminate <br /> prior to 10:00 p.m. However, pursuant to Development Title Section 9-1075.9(f)(1), outdoor amplified <br /> sound must terminate by 9:00 pm, which has been included in the recommended Conditions of approval. <br /> Therefore, impacts related to noise are expected to be less than significant. Additionally, Marketing <br /> Events; Accessory Wine Events, and Industry Events must comply with Development Title Section 9- <br /> 1025.9 regarding stationary noise standards (50 dB Hourly Equivalent Sound Level daytime, 45 dB <br /> Hourly Equivalent Sound Level nighttime, 70 dB maximum sound daytime, 65 dB maximum sound <br /> nighttime). Each of the noise level standards shall be reduced by 5 dB for noise primarily consisting of <br /> speech or music. <br /> Williamson Act <br /> The proposed project site is currently under the California Land Conservation act and subject to <br /> Williamson Act Contract No. 77-C1-135. The contract restricts development to uses that are compatible <br /> with the Williamson Act and Development Title Section 9-1805. "Compatible use" as defined in the <br /> Williamson Act includes uses determined by the County to be compatible with the agricultural, <br /> recreational, or open-space use of land within the preserve and subject to contract. (Government Code <br /> Section 51201[e]) In addition, Development Title Section 9-1810.3(1)(AA) permits wineries and wine <br /> cellars as a compatible use on contracted land. <br /> The winery will have wine available for sale at each Wine Release and Industry Event. The wine will be sold <br /> exclusively from the host winery. The parcel has approximately 59.14 acres of vineyards and the winery, <br /> Marketing.Events, Wine Release and Industry Events will encompass approximately 2 acres within existing <br /> developed area of the winery. Therefore, the Marketing, Wine Release and Industry Events with proposed <br /> amplified.sound for the winery are accessory uses and the proposed project is consistent with the required <br /> three principles of compatibility pursuant to Government Code Section 51238.1. <br /> Farm Bureau <br /> The San Joaquin Farm Bureau Federation submitted a comment letter dated April 25, 2018 regarding the <br /> addition of twelve (12) Marketing Events and outdoor amplified sound. The letter states that the Farm <br /> Bureau supports the application to allow for the addition of twelve (12) Marketing Events and the addition <br /> of amplified sound so long as it is consistent with the operational requirements of San Joaquin County <br /> Development Title Section 9-1075.9(f). <br /> Natural Resources <br /> There are two (2) oak trees on the property. To protect and preserve the oak tree from development and <br /> construction activity, the following standards shall be applicable: <br /> • Grade changes near or within the dripline of said oak trees shall comply with the following: <br /> • No grade changes shall occur within six feet of the trunk of the tree. <br /> • No grade changes shall occur that entail removing or adding more than six inches of soil in the <br /> protected zone of the tree. <br /> • Any grade changes within the protected zone of the tree shall be accomplished so as to <br /> prevent soil compaction and injury to or removal of the tree's roots. <br /> (Development Title Section 9-1505.5[a]). <br /> • Before grading operations may commence, a minimum five (5) foot high chain link fence or <br /> other comparable protective fencing shall be installed at the outermost edge of the protected <br /> zone of each tree or group of trees (Development Title Section 9-1505.5[b]). <br /> San Joaquin County PA-0900094/Bokisch <br /> Community Development Page 7 <br />
