k) NOISE: Implementation of the following recommendations shall be provided and comply <br /> with the following pursuant to the noise study prepared by J. C. Brennan and Associates <br /> dated April 10, 2017: <br /> (1) Outdoor and indoor amplified music shall be permitted at applicable events. <br /> (Development Title Section 9-1075.9(f). <br /> (2) Outdoor amplified sound shall be permitted between the hours of 10:00 a.m. and <br /> 9:00 p.m. (Development Title Section 9-1075.9(f)(1) <br /> (3) Stationary noise sources shall be consistent with Chapter 9-1025.9 of the _ <br /> Development Title. The maximum sound level is 50 dB Hourly Equivalent Sound <br /> Level daytime, 45 dB Hourly Equivalent Sound Level nighttime, 70 dB maximum <br /> sound daytime, 65 dB maximum sound nighttime. This applies to outdoor activity <br /> area receiving use, or applies at the lot line if no activity area is known. Each of the <br /> noise level standards specified shall be reduced by 5 dB for impulsive noise, single <br /> tone noise, or noise consisting primarily of speech or music. (Development Title <br /> Table 9-1025.9 Part II) <br /> 1) TREE PRESERVATION: Grade changes near or within the dripline of said oak trees <br /> shall comply with the following: <br /> 1) No grade changes shall occur within six (6)feet of the trunk of the tree. <br /> 2) No grade changes shall occur that entail removing or adding more than six (6) inches <br /> of soil in the protected zone of the tree. <br /> 3) Any grade changes within the protected zone (five feet outside the drip line <br /> extending inward to the trunk) of the tree shall be accomplished so as to prevent soil <br /> compaction and injury to or removal of the tree's roots. (Development Title Section 9- <br /> 1505.5[a]) <br /> 4) Before grading operations may commence, a minimum five (5) foot high chain link <br /> fence or other comparable protective fencing shall be installed at the outermost edge <br /> of the protected zone of each tree or group of trees (Development Title Section 9- <br /> 1505.5[b]). <br /> 5) No trenching whatsoever shall be allowed within the protected zone of subject trees <br /> (Development Title Section 9-1505.5[c]). <br /> 6) Paving within the dripline of affected trees shall be minimized. If paving is <br /> necessary, porous materials shall be used (Development Title Section 9-1505.5[e]). <br /> m) BUILDING CODE REQUIREMENTS: The following Uniform Building Code and San <br /> Joaquin County Ordinance requirements will be applicable and shall be incorporated in the <br /> construction plans before submittal to the Building Inspection Division: <br /> 1) The proposed use will change the occupancy from a U occupancy to a F1 occupancy <br /> (U.B.C. Section 3405). The structure must be brought into compliance with all current <br /> code provisions including structural, plumbing, mechanical, electrical, energy and <br /> disabled access requirements. A licensed architect or registered engineer shall prepare <br /> all documents. <br /> 5 <br />
