During the non-breeding season(September 1 through January <br /> 31)burrowing owls occupying the project site may be evicted from the <br /> project site by passive relocation as described by the(CDFG (2012). <br /> Burrow exclusion and closure is not permitted during the breeding <br /> season. <br /> • These Incidental Take Minimization Measures are consistent with the <br /> provisions of the MBTA. <br /> Loggerhead Shrike <br /> Loggerhead shrike has been observed foraging in the project area. Participation in <br /> the SJMSCP affords the project proponent Incidental Take authorization for <br /> loggerhead shrike pursuant to ESA,CESA and CEQA. Although little suitable <br /> nesting habitat is present on site, as outlined in the SJMSCPB,the following <br /> incidental take avoidance measures shall be followed: <br /> • Prior to the initiation of ground clearing,grubbing,grading or excavation <br /> activities, a scheduled to occur during the breeding season(i.e.,February 1 - <br /> August 15),preconstruction survey shall be performed by a qualified <br /> biologist. <br /> • A setback of 100 feet from loggerhead shrike nest sites shall be established <br /> and maintained during the nesting season(i.e., February 1 to August 15)for <br /> the period encompassing nest building and continuing until fledglings leave <br /> nests. This setback applies whenever construction or other ground- <br /> disturbing activities must begin during the nesting season in the presence of <br />
