HYDROLOGY,GEOHYDROLOGY,AND WATER QUALITY <br /> Introduction <br /> This section provides an overview of the existing conditions within the project area related to potential <br /> water quality and environmental concerns from releases of hazardous materials. It includes a review of <br /> hazardous materials regulatory framework and worker health and safe /environmental <br /> tY protection <br /> requirements,as well as an identification of past activities that may have produced the groundwater plume <br /> associated with the landfill that has migrated off-site. The water quality setting as presented in the 1994 <br /> EIR is summarized briefly,and then followed by a more detailed discussion of the setting elements that <br /> have emerged since 1994. The principal impact since the 1994 EIR is associated with new data collected <br /> that yields a better understanding of the extent of the off-site groundwater leachate plume associated with <br /> the landfill. In addition to new subsurface data collected,there have been some changes to <br /> the regula <br /> environment at the landfill regarding hazardous materials use and.reporting. This section replaces theory <br /> water quality analysis only;the 1994 EIR hydrologic analysis of flooding and runoff'quantities remains <br /> unchanged. <br /> Seftin <br /> 4 <br /> Background <br /> , 1994 EIR Sddng Summary <br /> Regulatory Setting. The California Code of Regulations(CCR)presents California's hazardous waste <br /> laws. In general, a material is a hazardous waste if it poses a threat to human health or the environment. <br /> Under California law, approximately 800 substances are listed as potentially hazardous depending upon <br /> their property or combination of properties. A hazardous waste can be present in a liquid, semi-solid, <br /> solid,or gaseous form. California law requires that the generator of a potentially hazardous waste <br /> determine if said material is in fact hazardous(as defined in CCR, Section 66471)and stipulates the <br /> criteria and analytical methods for the determination of a waste as hazardous(CCR, Section 66680 and <br /> 66693 et seq.). <br /> t <br /> k The use,production and disposal of hazardous materials and waste are regulated extensively by federal, <br /> state,regional, and local regulations and <br /> gu guidance,with major objectives of protecting the public health <br /> and the environment. These regulations and guidance were developed primarily for application in <br /> industrial and manufacturing environments where waste production as a byproduct of manufacturing <br /> occurs and worker health and safety is of concern. The U. S. Environmental Protection Agency (EPA)is <br /> [ the lead a responsible T <br /> agency res nsible for enforcing federal regulations that affect public_health and the <br /> F4environment. The EPA designates much of its regulatory authority to the individual states. California <br /> EPA enforces hazardous material laws and regulations 'gulations in California in conjunction with the federal EPA. <br /> F The California EPA is divided into two main enforcement agencies for the regulation and oversight of <br /> environmental contamination.by hazardous waste. These are the California Department of Toxic <br /> F! Substance Control(DTSC)and the California Regional Water Quality Control Boards(CRWQCB). In <br /> general, the DTSC is the lead agency on sites where the main concerns are human health and <br /> the mandate for the CRWQCB is the protection of the waters of California. while <br /> Local regulations on the county and city Level are involved in setting standards of care in the use,storage <br /> and handling of hazardous materials as described above.
