When transferred to private ownership,the landfill and expansion areas <br /> that were annexed by the City of Stockton would revert to the jurisdiction of San Joaquin County, <br /> because they would no longer fulfill the legal requirement of use for public purposes. i <br /> Although the landfill'site would no longer be within the city limits if the proposed project sale is <br /> implemented,the City makes General Plan designations for all land within its urban planning area,which <br /> includes unincorporated County areas outside the city limits. When the <br /> landfill is transferred to private ownership,the City would eliminate the landfill site from its zoning map. <br /> County of San Joaquin <br /> Re ug latory and Monitoring Responsibility. After the landfill reverts to County jurisdiction,the San <br /> Joaquin County Public Works/Solid Waste Division would assume responsibility for the local regulatory <br /> and monitoring functions now fulfilled by the City of Stockton Department of Public Works. The role of <br /> Local Enforcement Agency(LEA)for the California Integrated Waste Management Board (CIWMB), <br /> currently fulfilled by the CIWMB itself,would change to the San Joaquin County Department of Public <br /> Health,Environmental Health Division. The San Joaquin County Planning Department would take over <br /> jurisdiction for land use matters from the City of Stockton,and would have the authority to issue a Use <br /> 4 Permit for the expansion. <br /> I <br /> San Joaquin County General Plan Designations. When the landfill is transferred to private ownership, <br /> the land use designation of the 182.5-acre existing landfill,the 125-acre CYA parcel,and the 11-acre <br /> Triangular Property would be changed from P,Public(Public or Institutional)to A/G,Agriculture <br /> (General). The designation of the 83-acre Brocchini parcel would remain A/G. <br /> # i San Joaquin County Zone Classification. When the landfill is transferred to private ownership,the zone <br /> classification of the CYA parcel would be changed from the current P-F to AG-40. The other project <br /> parcels,which do not currently have a County zone classification,and would also be classified AG-40 by <br /> the County. The San Joaquin County Development Title specifies that Major Impact Services are allowed <br /> in AG zone classification areas,subject to a Use Permit. Major Impact Services,which include sanitary <br /> landfills,are defined as land intensive activities that must be located away from residences or <br /> concentrations of people due to the nature of the operation's impacts. <br /> After sale and reversion to County jurisdiction,the County's General Plan designation for the project site <br /> would take precedence over that of the City of Stockton,and the City would no longer have a zoning <br /> ' designation for the site. The project would be consistent with the County of San Joaquin General Plan <br /> and zone classification. For these reasons,the proposed project would not have a significant impact on <br /> GRASSSETTI ENVIRONMENTAL CONSULTING <br />
