Draft Supplemental Environmental Impact Report Page IV.H-4 <br /> Forward Inc. Landfill 2018 Expansion Project <br /> (d)In the event that human remains or any associated funerary artifacts are discovered <br /> during construction, all work shall cease within 50 feet of the discovery and,in <br /> accordance with requirements of the California Environmental Quality Act(Public <br /> Resources Code Section 15064.5[el),Public Resources Code Section 5097.98, and the <br /> California Health and Safety Code (Section 7050.5), the San loaquin County <br /> Sheriff/Coroner shall be contacted immediately. If the remains are deemed to be Native <br /> American, the Sheriff/Croner will notify the NAHC, which will in turn appoint and <br /> notify a Most Likely Descendent(MLD) to act as a tribal representative.The MLD will <br /> work with the County and a qualified archaeologist to develop a plan for the proper <br /> treatment of the human remains and associated funerary objects. Construction activities <br /> shall not resume until treatment has been completed. If recommendations are made and <br /> not accepted, during the mediation period, the Native American Heritage Commission <br /> shall mediate the issue and the Human Remains shall remain in the possession of the <br /> MLD. <br /> These revised mitigation measures would be incorporated into this project. <br /> Tribal Cultural Resources <br /> In June 2018,representatives of the Yokuts Tribe requested that a Sacred Lands File <br /> (SLF) search be conducted for the project site. A record search of the Native American <br /> Heritage Commission(NAHC)SLF was completed for the area of potential project effect <br /> (APE) for the project on July 10,2018.Sacred sites were identified in the project area <br /> provided.The NAHC recommended that the County contact the Northern Valley <br /> Yokuts Tribe directly for more information about sacred sites and tribal cultural <br /> resources within the APE. <br /> On August 7,2018 SAS emailed a letter and a map depicting the project area to the ' <br /> Native American Heritage Commission(NAHC).The letter requested a records search <br /> of the Sacred Lands File (SLF)for the project area, and for a list of local Native American ' <br /> tribal groups that should be contacted about the project.On August 24,2018, Ms. <br /> Sharaya Souza,Staff Services Analyst for the NAHC, replied in an emailed letter that <br /> SLF record search results resulted in the identification of a Sacred land in the project <br /> area, and that the Northern Valley Yokuts Tribe need to be contacted for more <br /> information. Ms.Souza also supplied a list of Native Americans to contact in regard to <br /> requesting official project recommendations and information on unrecorded cultural <br /> resources that may exist in the project area.On August 21, 2018,SAS mailed letters to <br /> the following Native American contacts identified by the NAHC: <br /> • Rhonda Morningstar Pope (Chairperson,Buena Vista Rancheria of Me-Wuk <br /> Indians) <br /> • Sara Dutschke Setchwaelo (Chairperson, Ione Band of Miwok Indians) <br /> • Katherine Erolinda Perez (Chairperson, North Valley Yokuts Tribe) ' <br /> • Gene Whitehouse(Chairperson,United Auburn Indian Community of the <br /> Auburn Rancheria [UAIC]) <br /> • Raymond Hitchcock(Chairperson,Wilton Rancheria) <br />
