The owner shall execute an Irrevocable Offer and Agreement to Dedicate Road to result in a <br /> twenty-five (25)foot wide right-of-way from the centerline of the private road (Biederman Way) <br /> to the property line across the parcel's frontage. (A$350.00 fee currently is required for- <br /> processing per Development Title Table 9-240.2 in addition to a copy of the Grant Deed and a <br /> legal description of the parcel to be offered for dedication.) (The fee due will be based on the <br /> current fee schedule.) (Development Title Section 9-1150.5) <br /> 4. The frontage improvements for the private road(Biederman Way) shall be constructed in <br /> conformance with the standards for one-half of a 50- foot right-of-way rural residential road. <br /> The construction of the frontage improvements will be deferred upon execution by the owner of a <br /> Deferred Frontage and Roadway Improvement Agreement or a Secured Deferred Frontage and <br /> Roadway Improvement Agreement with a deposit equivalent to their estimated construction costs <br /> prior to approval of the Improvement Plan. (A$410.00 fee currently is required for processing <br /> per Development Title Table 9-240.2 in addition to a copy of the Grant Deed and an estimate for <br /> the required frontage improvements. The estimate shall be prepared by a Registered Civil <br /> Engineer with a typical section drawing on a form to be supplied by the Department of Public <br /> Works and submitted to the Department of Public Works for approval. As an option,the <br /> Department of Public Works will prepare the drawing and estimate for an additional fee of <br /> $175.00.) (The fee due will be based on the current fee schedule.) <br /> (Development Title Section 9-1150.2) <br /> 5. The Traffic Impact Mitigation Fee shall be required for this development. The fee is due and <br /> payable at the time of building permit application. (The fee currently is $1,700 per single-family <br /> dwelling and $1,114 per multi-family dwelling in the Escalon area. The fee shall be automatically <br /> adjusted July 1 of each year by the Engineering Construction Cost Index as published by the <br /> Engineering News Record.) (Resolutions 00-433) <br /> 6. The Water Supply Facilities Impact Mitigation Fee shall be required for this development. The <br /> fee is due and payable prior to issuance of the building permit. (The fee currently is $2,545.9.1 per <br /> single-family dwelling and$763.79 for each additional unit. The fee shall be automatically <br /> increased on January I of each year through the year 2005 at the rate of 7.66 percent.) <br /> (Development Title Section 9-818.4 and Resolutions R-91-327, R-94-185 and R-97-5) <br /> 7. A copy of the Final Site Plan shall be submitted prior to release of building permit. <br /> 8. This area has been subject to historic flooding,therefore all new structures and/or substantial <br /> improvements constructed on the parcel shall be elevated a minimum of(2) feet above the highest <br /> adjacent grade. <br /> 9. Tributary of Temple Creek pass through the parcel. Therefore,the applicant shall keep the <br /> tributary free of all obstacles which impede the flow of water, and any alteration to the tributary <br /> will require obtaining a Watercourse Encroachment Permit from the San Joaquin County <br /> Department of Public Works. Furthermore,the tributary shall be delineated with a 25-foot <br /> building setback from the top of both banks of the channel. <br /> 10. A secondary method of access shall be provided and an access easement shall be acquired <br /> across private property. (Development Title Section 1150.16 [3]) <br />
