tl a <br /> I � <br /> Third, the Board has considered the improvements recently completed at the <br /> intersection of Bird Road and State Route 132 by Teichert Aggregates as a condition of <br /> approval of Quarry Excavation Permit QX-91-5. The Board has been supplied with a <br /> copy of the Project Study Report and Project Report approved by Caltrans in 1994 in <br /> connection with these improvements, and notes that Caltrans approved the adequacy of <br /> these documents and the improvements. The PSR/PR shows that the intersection can <br /> accommodate the truck trips associated with 4 million tons of aggregate extraction while <br /> maintaining a level of service of"C"or greater. The Board notes that the total annual <br /> production of existing and future producers utilizing the Bird Road/132 haul route, which <br /> include Teichert, Brown Sand and DSS Engineering Contractors,will not exceed 4 <br /> E million tons for approximately 40 years. Therefore, the Board finds that an interchange <br /> at Bird Road and State Route 132 is not needed for the foreseeable future. <br /> Finally,the Board has considered the fact that the application for Special Purpose <br /> Plan and Finance Plan for the Vernalis Interchange has been withdrawn. As a result, the <br /> Board finds that implementation of the Vernalis Interchange is neither financially feasible <br /> nor reasonably foreseeable within the meaning of CEQA, and the Board rejects any and <br /> all mitigation ineasures which call for the applicant's participation in the Vernalis <br /> Interchange. The Board also finds, based on the testimony of the applicant and <br /> representatives of DSS Engineering Contractors, that an interchange at Bird Road and <br /> State Route I32 is not feasible at this time due to the excessive costs associated with such <br /> an interchange. <br /> Thus, Impact 9-4, while still cumulatively significant, is significant for reasons <br /> which are largely unrelated to this project. The Board finds that Public Works Condition <br /> of Approval 2(e), which requires the applicant to pay the County's Traffic Impact <br /> Mitigation Fee, is sufficient to reduce the identified impact to a less than significant level. <br /> The Board expressly rejects the following requirements of Mitigation Measure 9-4 and <br /> items 2, 3 and 4 of Caltrans' August 1, 1997 letter: <br /> -signalization of the intersection of State Route 132 and Bird Road <br /> -payment of costs toward construction of I5/Bird Road Interchange <br /> -construction of a"median barrier" to prevent left turns at the Bird Road/132 <br /> intersection-this measure is further rejected in that it would increase the number, <br /> of vehicle miles traveled, with associated air quality impacts. <br /> -any requirement that would artificially reduce the level of aggregate production <br /> SIGNIFICANT LMPACT 9-5: "The traffic movements at this intersection will <br /> degrade to LOS "D", "E" and "F"...for traffic making left turns out of Koster Road..." <br /> FINDING: Changes or alterations have been required in or incorporated into the f <br /> project that avoid or substantially lessen the significant environmental effects as <br /> identified in the Final EIR. <br /> STA.TEVfENT OF FACT: Nfitigationn-Measure 9-5 states that Brown Sand will <br /> contribute its proportional share, based on its use of the intersection, to the reconstruction <br /> i <br />
