The structure must also provide handicapped accessible <br /> restrooms, provide a sprinkler system for the building, provide an acceptable exit system, and <br /> install a commercial hood for the kitchen. Because the restaurant is already in operation, <br /> compliance with these Code provisions is required in substantially less time than the normal 18- <br /> month approval period for a new use. The owner is being required to submit all necessary <br /> building permits and plans within 60 days of the effective date of the application's approval and <br /> complete all required construction and improvements within an additional six months. <br /> Fire Code Compliance: <br /> The proposed change in use and occupancy of the building has also resulted in the need to meet <br /> specific Uniform Fire Code and National Fire Protection Association requirements. Those <br /> requirements, which are contained in the Conditions of Approval, involve the need for an <br /> approved Fire Permit for the place of assembly, meeting minimum standards for the building's <br /> exits, maintaining emergency access for fire personnel and vehicles, providing a proper hood and <br /> duct system for the kitchen, securing a Fire Permit for the building's fire extinguishers, and <br /> installing an automatic sprinkler system for the building. <br /> FACILITIES/SERVICES: <br /> Water Supply: <br /> The owners have proposed to continue using the site's existing well for a water supply. The <br /> Environmental Health Division has responded to the request with Conditions, based upon Title <br /> 22 of the State Safe Drinking Water Act, requiring repairs to the well and meeting minimum <br /> standards for a public water supply system. <br /> Sewage Disposal: <br /> Sewage disposal will be provided by an existing on-site septic system that is located under paving <br /> near the southeast comer of the building. The facility will be allowed to continue using the system <br /> subject to its replacement under permit and inspection by the Environmental Health Division at <br /> such time that it fails. The replacement system will be subject to current Public Health standards <br /> and will not be permitted to be placed under paving. <br /> Storm Drainage: <br /> There are currently no facilities on the site to collect storm water runoff from existing <br /> improvements. At a minimum, Sections 9-1135.2{c} and 9-1135.9.of the Development Title <br /> require that additional storm drainage resulting from new construction or improvements,including <br /> paving, is to be collected in a retention pond to be constructed on the site or conveyed to <br /> terminal drainage. Because there are no downstream drainage facilities and because the site has <br /> never made provisions for drainage, all storm drainage generated by on-site and off-site <br /> improvements (existing and proposed) shall either be retained in on-site basins or discharged to <br /> the San Joaquin River. The latter will require State-level review of the project's environmental <br /> documents,approved permits from the State Reclamation Board,Reclamation District No. 17,and <br /> a National Pollution Discharge Elimination System (NPDES) permit.
