Bowman Road, French Camp <br /> I <br /> This department is requesting your assistance in pursuing <br /> appropriate legal action at the subject address for the operation <br /> of a banquet facility without the proper permit approvals. <br /> i <br /> The owners, Jim Silveria and Clint Marshall, converted a winery and <br /> warehouse facility (B-2 Occupancy) to an assembly area (A2. 1 <br /> occupancy) . Enforcement action was delayed since the owner was <br /> making an attempt to comply by applying for a use permit and <br /> applying for the proper building permits for the change of <br /> occupancy. This department allowed the use to continue as long as <br /> progress was being made toward compliance; and the Fire Department <br /> was monitoring the assembly. <br /> On August 24, 1994, Tom Gau, Senior Civil Engineer in Development <br /> Services, Engineering Division, explained the conditions that were <br /> needed to approve an Improvement Plan, which addressed the <br /> inadequate drainage facilities. This Improvement Plan has not been <br /> resubmitted and there has been no mitigation of the drainage <br /> problem. The Certificate of Occupancy cannot be issued until such <br /> time the Improvement Plan has been approved and the proper drainage <br /> facilities have been installed. <br /> In addition, revised plans for the bathrooms have been requested <br /> since the bathrooms were placed on the second story without f <br /> approvals. These bathrooms are presently inaccessible to persons <br /> with physical disabilities. <br /> The Public Works Department is also requesting that the Certificate <br /> of Occupancy not be issued until such time the Traffic Mitigation <br /> fees are paid. <br /> There may be other issues that are not listed as violations, but <br /> cannot be ascertained until such time as a final inspection is <br /> made. The building permit for the Change of Occupancy which was <br /> issued on August 26, 1994, has now expired, <br />
