� M <br /> 4 <br /> Farmland, Farmland of Statewide Significance, nor Unique Farmland. (Development <br /> Title Section 9-854.2) <br /> This site is zoned AG-40; the site is not designated Resource Conservation; the soil is prime <br /> farmland; and there are not substantial deposits of mineral resources. However, because this <br /> project is for the removal of excess material to increase the property's agricultural potential, the <br /> i Community Development Department determined that the Quarry application may be accepted. <br /> In addition, the Department determined that the project would have to meet the development <br /> requirements for an agricultural excavation permit. Specifically, the final grade shall have an <br /> average elevation no less than the average elevation of the natural grade of the surrounding <br /> land. The average elevation of the natural or existing grade shall be the average elevation of all <br /> land one hundred (100) feet from the perimeter of the proposed excavation, excluding any <br /> ` portion of the perimeter adjacent to a river, riverbank, levee, public road, railroad, canal, <br /> pipeline, or other similar uses or rights-of-way (Development Title Section 9-1410.3(b-4)). <br /> The applicant has proposed to remove up to three (3) feet of topsoil across the surface of the <br /> three parcels. There are some areas where soil will be filled in order to level out the land. The <br /> adjacent properties have an average ground design grade of 13.9 feet. This number was <br /> calculated by taking the adjacent ground design grade levels approximately fifty (50) to one <br /> hundred (100) feet from the quarry site's property lines and averaging them. As a <br /> recommended condition of approval, the final finished grade elevation shall be no lower than <br /> 13.9 feet. <br /> Topsoil Removal <br /> The applicant is proposing to remove the topsoil and distribute it off site. According to <br /> Development Title Section 9-1415.3(g), in agricultural areas, the topsoil shall be set aside, and <br /> upon completion of an excavation, the topsoil shall be replaced and the site leveled in <br /> conformance with the excavation permit. This requirement may be waived if the property is to <br /> be rehabilitated for a use; other than agriculture, which is consistent with the General Plan, or if <br /> a soils report indicates the replacement of the topsoil will not enhance the agricultural suitability <br /> of the property. <br /> ' The applicant is in the process of conducting the soils report. This project is tentatively <br /> scheduled for the Planning Commission meeting of September 20, 2001. The soils report must <br /> ' be submitted for review by this department prior to August 31, 2001, for preparation of the <br /> preliminary staff report. <br /> k The Community Development Department has reviewed the Quarry Permit application and will <br /> be recommending that the Planning Commission approve the project subject to the following <br /> Conditions of Approval: <br /> Quant' Excavation Application No. QX-01-1 was approved by the Planning Commission on . <br /> The effective date of approval is . This approval will expire on , which is 18 months from the <br /> date of approval, unless (1) all Conditions of Approval have been complied with, (2) aH <br /> necessary building permits have been secured and remain in force, and (3) all necessary <br /> permits from other agencies have been secured and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be <br /> fulfilled prior to the establishment of the use and the issuance of any building permits. <br /> Those Conditions followed by a Section Number have been identified as ordinance <br /> f - <br />
