b 10. The conclusion of the EIR was that there would be no significant, unavoidable adverse impacts related to cultural resources. However, in the event that such resources or human remains are discovered on the site, specific actions are required to protect them. 13 . a. The project was not found by the ETR to be a growth- inducing action. 14 . The loss of agricultural land and air quality impacts associated with the project were the only cumulative impacts identified by the EIR. In approving the earlier General Plan Map Amendment and Zone Reclassification applictions, the Board of Supervisors adopted both "Findings of Significant Environmental Impact" and "Statements of Overriding Considerations. " Approval of this application would require that the same actions be taken by the Board of Supervisors. 16.a. The EIR indicated that the project would have an adverse impact upon the habitat ' of the Swainson's hawk and would result in adverse cumulative air quality impacts. The former .>. will be mitigated at the tentative map stage by either the acquisition and improvement of off-site foraging habitat or by entering into an agreement to join -the City of Stockton's Swainson's Hawk Habitat Conservation Program. The latter cannot be mitigated to a less than significant level and will require the adoption of appropriate Findings and Statements. 16.b. & c.
