Storm Water Management Plan <br /> KRC Aggregate, Inc. <br /> Lodi, California <br /> 1.0 INTRODUCTION <br /> On behalf of KRC Aggregate, Inc. (KRC), BSK&Associates (BSK) has prepared this Storm <br /> Water Management Plan (Plan) which will govern site operations with respect to eliminating <br /> storm water discharges. KRC is engaged in the mining and processing of aggregates for use <br /> in construction, with related business and maintenance activities. Operations at the site <br /> include mining, crushing, washing and sorting of sand and gravel. <br /> In 1972,the Federal Water Pollution Control Act was amended to provide that the discharge <br /> of pollutants to waters of the United States from any point source is effectively prohibited, <br /> unless the discharge is in compliance with a National Pollutant Discharge Elimination System <br /> (NPDES) permit. Amendments to the Act, made in 1987, establish a framework for <br /> regulating industrial storm water discharges under the NPDES program. Regulations, <br /> established in 1990 by the U.S.Environmental Protection Agency, require specific categories <br /> of facilities which discharge storm water associated with an industrial activity to obtain an <br /> NPDES permit. Dischargers requiring a permit are listed by category in Title 40 of the <br /> Code of Federal Regulations (CFR) Section 122.26(b)(14). Included in these categories are <br /> mining facilities. <br /> As provided for in the Final Rule, NPDES Permit Application Regulations (Federal <br /> Register/Vol. 55, No. 222, page 48032) "If the owner or operator determines that no storm <br /> water runoff comes into contact with overburden, raw material, intermediate product, finished <br /> product, byproduct, or waste products, then there is no obligation to file a permit application." <br /> 1.1 Policy and Objectives <br /> It is the policy of KRC that operations at the site be conducted in a manner appropriate for <br /> the protection, health and safety of the environment and the public at large. The purpose <br /> of the Plan is to outline operational protocols to eliminate the discharge of storm water from <br /> the facility to waters of the United States and to provide documentation demonstrating that <br /> KRC is not obligated to file a permit application or comply with monitoring and reporting <br /> requirements for storm water discharges associated with industrial activities. <br /> This document will be made available to the public at large at the offices of KRC Aggregate, <br /> Inc. from Monday through Friday between the hours of 8:00 am and 5:00 pm.
