Recommendations
Action
It Is recommended that the Planning Commission:
1. Approve the Negative Declaration; and
2. Approve Minor Subdivision Application No. MS-94-11 subject to the Findings and Conditions
of Approval contained In the staff report.
Findings
1. The proposed subdivision is consistent with the General Plan, any applicable Master Plan,
Specific Plan, and Special Purpose Plan, and any other applicable plan adopted by the County.
• This Finding can be made because the proposed subdivision Is consistent with the
General Plan and the Policies of the Limited Agriculture designation on the General
Plan Map. There are no Specific or Special Purpose Plans on the subject parcel.
2. The design or improvement of the proposed subdivision is consistent with the General Plan and
any applicable Specific Plan or Special Purpose Plan.
This Finding can be made because all of the lots will either have the minimum
required frontage on County maintained roads and meet all minimum Improvement
requirements of the General Plan or be served by a private right-of-way that meets
minimum improvement requirements of the General Plan and the Uniform Fire Code
as reflected in the tentative parcel map.
1 The site is physically suitable for the type of development proposed.
• This Finding can be made because all development requirements In the County's
Development Title and all minimum County standards are met. The parcels are large
enough to provide onsite services.
4. The site is physically suitable for the proposed density of development.
This Finding can be made because the subdivision of the 25-acre project site Into
three parcels is within the maximum allowable density for areas designated Limited
Agriculture by the General Plan.
5. Neither the design of the subdivision nor any proposed improvements are likely to cause
substantial environmental damage or substantially and avoidably injure fish or wildlife or their
habitat.
This Finding can be made because the Initial Study that was prepared for this project
indicated that there will be no significant adverse impacts on the environment or upon
threatened or endangered species.
San Joaquin County MS-94-11/Bader
Community Development Page 6
