Navarra Property 7500 WestQventh Street, Tracy, California Page 2 <br /> Specific fire safety equipment that will be present on the site at all times when the remedial <br /> excavation is being actively worked will include four(4) 120 B:C Underwriters Laboratory-rated <br /> fire extinguishers containing dry siliconized potassium bicarbonate fire suppressant. These units <br /> will be in addition to one (1) multipurpose, mono-ammonium phosphate dry chemical, 1A:1OB:C <br /> rated fire extinguisher. <br /> Prior to the opening of the extraction trench, SJC will notify the Tracy Fire Department so that, if <br /> he elects to do so, the fire chief can arrange to have fire department personnel present on site <br /> while the work is in progress. <br /> Control of access to the site during remedial activities and requirements for control of access to <br /> the working area are included in the Project-specific Health and Safety Plan that is included as <br /> Appendix A of the CAP. When the site is not being worked, the extraction trench will be secured <br /> behind a locked, temporary 6-ft, high chain link fence located as shown on Figure 1 (attached). <br /> Site Access Agreement <br /> Prior to the fall of 2007, SJC had an agreement in place with Capitol Furniture, the then owner of <br /> 7501 West Eleventh Street, for necessary access to the property for implementation of <br /> environmental management. At that time Capitol Furniture sold the property to Mr. Russ Zelmer, <br /> who is currently offering the property for sale or lease. Sale negotiations have in least one case <br /> progressed to the prospective buyer's due diligence phase, but no real estate transaction has <br /> closed. This uncertainty of future ownership of the 7510 West Eleventh Street property has <br /> delayed our consummation of an access agreement to permit remediation work to be initiated. <br /> In preliminary discussions with SJC, Mr. Zelmer has expressed concern that while remediation <br /> work is in progress in the parking lot at 7501 West Eleventh Street, it may inhibit the sale or lease <br /> of the property and he has indicated that he would prefer that any remediation work be deferred <br /> until he can sell or lease the property. However, SJC will continue to negotiate with W. Zelmer <br /> for access to the site and has prepared the attached draft agreement for his consideration. <br /> We will inform you when we have reached agreement for access with Mr. Zelmer or if we believe <br /> that it may be necessary to call upon the assistance of the SJCEHD for those negotiations. <br /> Sincerely, <br /> Of Ess�oa <br /> ATS ql�y <br /> D.
