Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Site Approval No. PA-0500726 with the Findings and Conditions of Approval contained <br /> in the staff report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This Finding can be made because the composting facility proposed (Use Type: <br /> Agricultural Wastes) in application PA-0500726 is permitted in the AG-40 zone with an <br /> approved Site Approval application and is consistent with the A1G General Plan <br /> designation and the County Right-to-Farm ordinance.There are no applicable San Joaquin <br /> County Master Plans, Specific Plans, or Special Purpose Plans in the vicinity.The City of <br /> Lathrop has a Specific Plan that is within their city limits that designates the area to the <br /> south of the project site as residential and commercial. However,to implement the <br /> Specific Plan,the City will need to cancel or non-renew several Williamson Act contracts <br /> south of the project site.This is not expected to happen within the lease period of the <br /> composting facility. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This Finding can be made because all utilities, improvements, and other facilities are <br /> existing or will be provided as reflected in the approved site and/or improvement plan(s). <br /> Projects in the AG-40 zone may utilize a private septic system,an individual well, and on <br /> site drainage. No new utilities are required or recommended.This project will use a private <br /> septic system, an individual well,and on site drainage. Access is from Frewert Road, <br /> which is a publicly maintained rural residential road. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This Finding can be made because the property is adequate in size to accommodate the <br /> provisions of the Development Title.The parcel is 31.4 acres in size.The project will be <br /> twenty acres in size when Phase 3 is complete. The parcel size permits adequate <br /> movement of all necessary equipment, including fire suppression equipment.
