White, Etal c/o Moyer Consulting <br /> 7229 Shoreham Place PO Box 207 <br /> Stockton, CA 95207 Ripon, CA 95366 <br /> Dear Mr. Gau: <br /> The San Joaquin County Department of Aviation (Stockton Metropolitan Airport) has reviewed the <br /> above-referenced application with respect to those areas germane to the operations of the Stockton <br /> Metropolitan Airport. <br /> Although the 65 db "community noise equivalent level" (CNEL) contours for Stockton Metropolitan <br /> Airport do not extend over the proposed project, this area may be subjected to the "single event noise <br /> exposure level" (SENEL) as this project is located in an area which is subjected to periodic overflight and <br /> resultant noise which was ascertained from field monitoring of both military and civil aircraft operations. <br /> Accordingly, the Department of Aviation is recommending that as a condition of approval, County <br /> Planning require the applicant to grant a Deed of Avigation and Hazard Easement to the County to <br /> protect the operational environs of the Stockton Metropolitan Airport, now and for the future. <br /> Enclosed for the project application package is a Deed of Avigation and Hazard Easement. The intent <br /> of such easement is to grant to the County a perpetual, assignable easement permitting overflight of the <br /> property by aircraft, together with any inherent noise or other emissions which are inherent in the <br /> operation of aircraft. The easement should be recorded as a deed restriction and/or C.C. & R's <br /> (Covenants, Conditions and Restrictions) applicable to the property flowing in perpetuity to all successor <br /> property owners. <br /> If you should require further information or clarification regarding our recommendations, please do not <br /> hesitate to contact me.
