Jones:. i <br /> The California Department of Transportation(Department) appreciates the opportunity to have ; <br /> reviewed the Mitigated Negative Declaration for Use Permit Application No. PA-0700923 for <br /> the proposed St. Patrick's.Church project located at the northwest comer of the Intersec#iom of <br /> State Route 120(SR 120)/Carrolton Road. The Department reiterates the following comments <br /> previously provided on April 17, 2008:- <br /> 1 The Executive';Summary does not adequately address Phases 3 or Phase 4. Phase 3,to be <br /> built by 2027, includes a 200-student K-8 elementary school and youth center,while Phase 4, <br /> to be built by 2037 includes a community center and convent. Considering the potential trip <br /> generation and'impaets of Phase_ 3 in the Cumulative 2030 condition,it is important to fully <br /> address this phase and impacts. It appears that Cumulative condition(including Phase 3) <br /> does not fully address its' mitigation in the Executive Summary since the TTS assumes that <br /> the church project would not pay a fair shave cost since the expressway project is currently 4 <br /> " being evaluated and not officially adopted. <br /> Page iii discusses the Cumulative+Project mitigation. It states that since a new limited access <br /> expressway is ,being studied and a fivading mechanism is not in place for the potential <br /> expressway protect,the St. Patrick's Church project cannot pay its fair share cost. However, <br /> the TIS states that the Transportation Concept Report(TCR)has a concept facility as a 4-lane <br /> conventional highway with left-tuna lanes. Additionally,it states that the SJ County 2007 <br /> Regional Transportation Plan(RTP)2007 identifies widening SR 120 to a 5-lane <br /> conventional highway under an unfunded Ties' 1 project. Since the previously mentioned <br /> expressway is rot adopted,then the church should pay fair share based on the current <br /> "Caltrans improves mobility across Conifornia" <br /> ii <br />
