U , <br /> Recommendations ` <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Use Permit Application No. PA-0700293 with the Findings and Conditions of Approval <br /> contained in the.staff report. <br /> Findings <br /> �. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any <br /> applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> ;i_ <br /> This finding can be made because the Use Types Religious Assembly-Regional and <br /> Educational;,Services-General may be conditionally permitted in the AG-40 zone (General <br /> Agriculture,:'.40-acre minimum) with an approved Use Permit application. The project site <br /> has a General Plan designation of AIG (General Agriculture) and is within an agriculturally <br /> developed•a'rea. There are no applicable Master Plans, Specific Plans, Special Purpose <br /> Plans, or any other applicable plans which are within the vicinity of this project. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> This finding can be made because the applicant has sufficient access to water with an on- <br /> site well. Sewer will be maintained with a septic system. Storm drainage will remain on-site <br /> n of a 25 foot <br /> with a retention basin. The Department of Public Works is requiring a dedication <br /> wide right-of-way from the centerline of Carrolton Road to the property line along the <br /> frontage of the parcel as well as frontage improvements for Carrolton Road along the parcel. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> This finding�;can be made because the proposed project site of 22 acres is of adequate size <br /> and shape to accommodate the proposed use and all yards, building coverage, setbacks <br /> and other requirements of the Development Title. The Site Plan demonstrates that there is <br /> sufficient arga for parking, circulation and two-way access. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be <br /> injurious to the property or improvements of adjacent properties. <br /> This finding,can be made because the potential traffic impacts identified in.the Initial Study <br /> prepared for the project were mitigated to a less than significant level. Mitigation measures <br /> from the traffic study, dated June 2, 2008, conducted by KD Anderson & Associates, Inc., <br /> will be incorporated as Conditions of Approval to ensure any impacts to traffic are less <br /> than significant. <br /> San Joaquin County PA-07002931St. Patrick's Church <br /> Page 5 <br /> Community Development <br />
