2. A State Central Valley Flood Protection Board Permit shall be obtained for any <br /> work performed on their facilities (Detention Basin and the Diverting Canal), <br /> which will require an Endorsement from the San Joaquin County Flood Control <br /> and Water Conservation District. <br /> 3. The cost for any extension, connection, or placement of new facilities shall be <br /> borne by the applicant An improvement plan, consistent with the approved <br /> drainage study, shall be submitted for review and approval prior to consent of a <br /> parcel map, final map, building permit, or grading permit. <br /> 4. The applicant shall comply with both the San Joaquin County Development Title <br /> and Improvement Standards. <br /> Bases for Zone Reclassification <br /> Development Title Section 9-812.4 states that prior to approving an application for a Zone <br /> Reclassification, the Planning Commission and Board of Supervisors shall determine that all of <br /> the following are true: <br /> a) The proposed zone is consistent with the General Plan, any applicable Master Plans, and <br /> any applicable Specific Plan, <br /> • The proposed Zone Reclassification to change the zoning to I-G (General <br /> Industrial) is consistent with the current General Plan designation of I/G (General <br /> Industrial),the applicant has provided "will-serve" letters for public water, sewer. <br /> and storm drainage. There are no applicable Master Plans or Specific Plans in the <br /> vicinity. <br /> b) The proposed zone district is reasonable and beneficial at the time <br /> • The proposed Zone Reclassification is reasonable and beneficial at this time as <br /> access to a public water system, sewer facilities and stormwater drainage system <br /> will be provided to serve the underlying industrial business park. <br /> Agricultural Mitigation <br /> The current zoning for this parcel is AU-20 (Agriculture-Urban Reserve, 20-acre minimum) and <br /> the proposed Zone Reclassification application would be subject to the Agricultural Mitigation <br /> Ordinance of the Development Title. The Ordinance requires agricultural mitigation for a Zone <br /> Reclassification that changes the permitted uses from an agricultural to a nonagricultural use. <br /> (Development Title Section 9-1080.3(x)(2)) The underlying project is an industrial business park. <br /> Agricultural mitigation is satisfied by granting a farmland conservation easement or other <br /> farmland conservation mechanism as set forth in Subsection (d) of this Section to or for the <br /> benefit of a Qualifying Entity. The number of acres of agricultural mitigation land shall be at least <br /> equal to the number of acres that will be changed to a nonagricultural use [a 1:1 ratio]. <br /> (Development Title Section 9-1080.3(x.)) Submission of the required legal instrument or payment <br /> of the in-lieu fee shall occur at the time of grading permit or building permit issuance for the <br /> underlying development project.
