GP-01-5 OF
ALBERT GIUNTOLI, ET AL (SECOND SUPERVISORIAL DISTRICT) Y
IT IS RECOMMENDED:
That the Board of Supervisors:
1. Approve the Negative Declaration;
2. Adopt a Motion of Intent to approve General Plan Map Amendment Application
No. GP-01-5 based on the ability to make the basis for General Plan Amendment
(Attachment"A").
F
BACKGROUND:
An inquiry regarding the zoning of two of the subject properties was received by the Community
Development Department. Upon checking, it was determined that the properties were zoned R-L
while the General Plan designation was CIG. Because the R-L zone did not implement the CIG
General Plan designation, further research was done, and it was determined that the discrepancy
affected the four subject properties. The four subject properties are zoned R-L, and each is
developed with a single-family residence. The proposed General Plan Map Amendment will
make the General Plan designation consistent with the zoning and the development of the
property. The matter was brought before the Board of Supervisors on February 27, 2001. The
Board of Supervisors considered the matter and, in Board Order B-01-260, authorized the
Community Development Department to initiate a General Plan Map Amendment to change the
General Plan designation from CIG to RIL.
REASON FOR RECOMMENDATION:
The Planning Commission considered this matter at its meeting of May 17, 2001. The project
remained on the consent calendar and the Planning Commission voted 6-0 to refer this item to
the Board of Supervisors with the above recommendation. One Commissioner was absent. This
project is consistent with the General Plan and Board Order B-00437, pertaining to the General
Plan Review, adopted April 11, 2000.
A legal ad for the public hearing was published in the Stockton Record on June 2, 2001, and 30
public hearing notices were mailed on May 30, 2001.
BOS LETTER PAGE 1
f
