r - <br /> CONDITIONS OF APPROVAL <br /> SA-96-44 <br /> Crites <br /> Site Approval Application No. SA-96-44 was approved by the San Joaquin County Community <br /> ' Development Department on September 11, 1996. The effective date of approval is September 21, <br /> 1996, This approval will expire on March 23, 1998, which is 18 months from the effective date of <br /> approval, unless (1) all Conditions of Approval have been complied with, (2) all necessary building <br /> €. permits have been secured and remain in force, and (3) all necessary permits from other agencies <br /> r <br /> have been secured and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions. <br /> followed by a Section Number have been identified as Ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other Ordinance requirements may <br /> apPly- <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: (Staff Contact: Kerry Sullivan, 468-3140) <br /> a. BUILDING PERMIT: Submit an"Application -Commercial Building Permit." The Site Plan <br /> prepared as a part of the building permit must be prepared by a registered civil engineer <br /> or licensed architect. This Plan must show drainage, driveway access details (including <br /> gates), on-site parking, landscaping, signs, existing and proposed utility services, and <br /> grading (refer to the "Site Plan Checklist' for details). A fee is required for the Site Plan <br /> review. (Development Title Section 9-884) <br /> a <br /> b. APPROVED USE: This approval is for a 120-foot-high communications tower with <br /> antenna (use type: utility services, cellular facilities) and two equipment cabinets, as <br /> shown on the Plan submitted July 26, 1996. <br /> 2. U. S. FISH AND WILDLIFE SERVICE: (Staff Contact: Sheila Larson) <br /> a. Within 60 days prior to any construction related activities, preconstruction surveys shall <br /> be conducted by a qualified biologist to determine that no San Joaquin kit fox dens are <br /> located within or immediately adjacent (i.e., 1000 feet) to the area of work. This includes <br /> the foot print of the tower, temporary trench for power and telephone lines, temporary <br /> placement of spoils, temporary storage of equipment, and the access road. The results <br /> of the survey shall be submitted to the County Community Development Department, U. <br /> S. Fish and Wildlife Service, and California Department of f=ish and Game. If a kit fox den <br /> l is detected during the preconstruction surveys, a fenced (temporary fence such as <br /> wooden stakes with rope or cord will be considered sufficient) exclusion zone with a 100- <br /> foot diameter will be established to ensure that the den will not be affected by the <br /> completion of the project. A qualified biologist will meet with the construction crew prior <br /> to any project related activities to ensure that each member of the construction team <br /> understands the mitigation measures that are to be implemented to reduce or eliminate <br /> potential impacts to the kit fox. The 1000-foot trench will be constructed with ramps of <br /> either fill or planks to prevent kit foxes (or other species, for that matter) from becoming <br /> 1 entrapped in the trench. This trench will be checked each morning prior to work to <br /> ensure that no fox or other wildlife is trapped.
